Tan<\/strong><strong>\u0131<\/strong><strong>mlar<\/strong><\/p>\n<p><strong>Ama<\/strong><strong>\u00e7<\/strong><\/p>\n<p><strong>MADDE 1 <\/strong><strong>\u2013<\/strong> (1) Bu Kanunun amac\u0131; i\u015fyerlerinde i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011finin sa\u011flanmas\u0131 ve mevcut sa\u011fl\u0131k ve g\u00fcvenlik \u015fartlar\u0131n\u0131n iyile\u015ftirilmesi i\u00e7in i\u015fveren ve \u00e7al\u0131\u015fanlar\u0131n g\u00f6rev, yetki, sorumluluk, hak ve y\u00fck\u00fcml\u00fcl\u00fcklerini d\u00fczenlemektir.<\/p>\n<p><strong>Kapsam ve istisnalar<\/strong><\/p>\n<p><strong>MADDE 2 <\/strong><strong>\u2013<\/strong> (1) Bu Kanun; kamu ve \u00f6zel sekt\u00f6re ait b\u00fct\u00fcn i\u015flere ve i\u015fyerlerine, bu i\u015fyerlerinin i\u015fverenleri ile i\u015fveren vekillerine, \u00e7\u0131rak ve stajyerler de d\u00e2hil olmak \u00fczere t\u00fcm \u00e7al\u0131\u015fanlar\u0131na faaliyet konular\u0131na bak\u0131lmaks\u0131z\u0131n uygulan\u0131r.<\/p>\n<p>(2) Ancak a\u015fa\u011f\u0131da belirtilen faaliyetler ve ki\u015filer hakk\u0131nda bu Kanun h\u00fck\u00fcmleri uygulanmaz:<\/p>\n<p>a) Fabrika, bak\u0131m merkezi, dikimevi ve benzeri i\u015fyerlerindekiler hari\u00e7 T\u00fcrk Silahl\u0131 Kuvvetleri, genel kolluk kuvvetleri ve Milli \u0130stihbarat Te\u015fkilat\u0131 M\u00fcste\u015farl\u0131\u011f\u0131n\u0131n faaliyetleri.<\/p>\n<p>b) Afet ve acil durum birimlerinin m\u00fcdahale faaliyetleri.<\/p>\n<p>c) Ev hizmetleri.<\/p>\n<p>\u00e7) \u00c7al\u0131\u015fan istihdam etmeksizin kendi nam ve hesab\u0131na mal ve hizmet \u00fcretimi yapanlar.<\/p>\n<p>d) H\u00fck\u00fcml\u00fc ve tutuklulara y\u00f6nelik infaz hizmetleri s\u0131ras\u0131nda, iyile\u015ftirme kapsam\u0131nda yap\u0131lan i\u015fyurdu, e\u011fitim, g\u00fcvenlik ve meslek edindirme faaliyetleri.<\/p>\n<p><strong>Tan<\/strong><strong>\u0131<\/strong><strong>mlar<\/strong><\/p>\n<p><strong>MADDE 3 <\/strong><strong>\u2013<\/strong> (1) Bu Kanunun uygulanmas\u0131nda;<\/p>\n<p>a) Bakanl\u0131k: \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131n\u0131,<\/p>\n<p>b) \u00c7al\u0131\u015fan: Kendi \u00f6zel kanunlar\u0131ndaki stat\u00fclerine bak\u0131lmaks\u0131z\u0131n kamu veya \u00f6zel i\u015fyerlerinde istihdam edilen ger\u00e7ek ki\u015fiyi,<\/p>\n<p>c) \u00c7al\u0131\u015fan temsilcisi: \u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi ile ilgili \u00e7al\u0131\u015fmalara kat\u0131lma, \u00e7al\u0131\u015fmalar\u0131 izleme, tedbir al\u0131nmas\u0131n\u0131 isteme, tekliflerde bulunma ve benzeri konularda \u00e7al\u0131\u015fanlar\u0131 temsil etmeye yetkili \u00e7al\u0131\u015fan\u0131,<\/p>\n<p>\u00e7) Destek eleman\u0131: Asli g\u00f6revinin yan\u0131nda i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi ile ilgili \u00f6nleme, koruma, tahliye, yang\u0131nla m\u00fccadele, ilk yard\u0131m ve benzeri konularda \u00f6zel olarak g\u00f6revlendirilmi\u015f uygun donan\u0131m ve yeterli e\u011fitime sahip ki\u015fiyi,<\/p>\n<p>d) E\u011fitim kurumu: \u0130\u015f g\u00fcvenli\u011fi uzman\u0131, i\u015fyeri hekimi ve di\u011fer sa\u011fl\u0131k personelinin e\u011fitimlerini vermek \u00fczere Bakanl\u0131k\u00e7a yetkilendirilen kamu kurum ve kurulu\u015flar\u0131n\u0131, \u00fcniversiteleri ve T\u00fcrk Ticaret Kanununa g\u00f6re faaliyet g\u00f6steren \u015firketler taraf\u0131ndan kurulan m\u00fcesseseleri,<\/p>\n<p>e) Gen\u00e7 \u00e7al\u0131\u015fan: Onbe\u015f ya\u015f\u0131n\u0131 bitirmi\u015f ancak onsekiz ya\u015f\u0131n\u0131 doldurmam\u0131\u015f \u00e7al\u0131\u015fan\u0131,<\/p>\n<p>f) \u0130\u015f g\u00fcvenli\u011fi uzman\u0131: \u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi alan\u0131nda g\u00f6rev yapmak \u00fczere Bakanl\u0131k\u00e7a yetkilendirilmi\u015f, i\u015f g\u00fcvenli\u011fi uzmanl\u0131\u011f\u0131 belgesine sahip m\u00fchendis, mimar veya teknik eleman\u0131,<\/p>\n<p>g) \u0130\u015f kazas\u0131: \u0130\u015fyerinde veya i\u015fin y\u00fcr\u00fct\u00fcm\u00fc nedeniyle meydana gelen, \u00f6l\u00fcme sebebiyet veren veya v\u00fccut b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fc ruhen ya da bedenen \u00f6zre u\u011fratan olay\u0131,<\/p>\n<p>\u011f) \u0130\u015fveren: \u00c7al\u0131\u015fan istihdam eden ger\u00e7ek veya t\u00fczel ki\u015fi yahut t\u00fczel ki\u015fili\u011fi olmayan kurum ve kurulu\u015flar\u0131,<\/p>\n<p>h) \u0130\u015fyeri: Mal veya hizmet \u00fcretmek amac\u0131yla maddi olan ve olmayan unsurlar ile \u00e7al\u0131\u015fan\u0131n birlikte \u00f6rg\u00fctlendi\u011fi, i\u015fverenin i\u015fyerinde \u00fcretti\u011fi mal veya hizmet ile nitelik y\u00f6n\u00fcnden ba\u011fl\u0131l\u0131\u011f\u0131 bulunan ve ayn\u0131 y\u00f6netim alt\u0131nda \u00f6rg\u00fctlenen i\u015fyerine ba\u011fl\u0131 yerler ile dinlenme, \u00e7ocuk emzirme, yemek, uyku, y\u0131kanma, muayene ve bak\u0131m, beden ve mesleki e\u011fitim yerleri ve avlu gibi di\u011fer eklentiler ve ara\u00e7lar\u0131 da i\u00e7eren organizasyonu,<\/p>\n<p>\u0131) \u0130\u015fyeri hekimi: \u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi alan\u0131nda g\u00f6rev yapmak \u00fczere Bakanl\u0131k\u00e7a yetkilendirilmi\u015f, i\u015fyeri hekimli\u011fi belgesine sahip hekimi,<\/p>\n<p>i) \u0130\u015fyeri sa\u011fl\u0131k ve g\u00fcvenlik birimi: \u0130\u015fyerinde i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi hizmetlerini y\u00fcr\u00fctmek \u00fczere kurulan, gerekli donan\u0131m ve personele sahip olan birimi,<\/p>\n<p>j) Konsey: Ulusal \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Konseyini,<\/p>\n<p>k) Kurul: \u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi kurulunu,<\/p>\n<p>1) Meslek hastal\u0131\u011f\u0131: Mesleki risklere maruziyet sonucu ortaya \u00e7\u0131kan hastal\u0131\u011f\u0131,<\/p>\n<p>m) Ortak sa\u011fl\u0131k ve g\u00fcvenlik birimi: Kamu kurum ve kurulu\u015flar\u0131, organize sanayi b\u00f6lgeleri ile T\u00fcrk Ticaret Kanununa g\u00f6re faaliyet g\u00f6steren \u015firketler taraf\u0131ndan, i\u015fyerlerine i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi hizmetlerini sunmak \u00fczere kurulan gerekli donan\u0131m ve personele sahip olan ve Bakanl\u0131k\u00e7a yetkilendirilen birimi,<\/p>\n<p>n) \u00d6nleme: \u0130\u015fyerinde y\u00fcr\u00fct\u00fclen i\u015flerin b\u00fct\u00fcn safhalar\u0131nda i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi ile ilgili riskleri ortadan kald\u0131rmak veya azaltmak i\u00e7in planlanan ve al\u0131nan tedbirlerin t\u00fcm\u00fcn\u00fc,<\/p>\n<p>o) Risk: Tehlikeden kaynaklanacak kay\u0131p, yaralanma ya da ba\u015fka zararl\u0131 sonu\u00e7 meydana gelme ihtimalini,<\/p>\n<p>\u00f6) Risk de\u011ferlendirmesi: \u0130\u015fyerinde var olan ya da d\u0131\u015far\u0131dan gelebilecek tehlikelerin belirlenmesi, bu tehlikelerin riske d\u00f6n\u00fc\u015fmesine yol a\u00e7an fakt\u00f6rler ile tehlikelerden kaynaklanan risklerin analiz edilerek derecelendirilmesi ve kontrol tedbirlerinin kararla\u015ft\u0131r\u0131lmas\u0131 amac\u0131yla yap\u0131lmas\u0131 gerekli \u00e7al\u0131\u015fmalar\u0131,<\/p>\n<p>p) Tehlike: \u0130\u015fyerinde var olan ya da d\u0131\u015far\u0131dan gelebilecek, \u00e7al\u0131\u015fan\u0131 veya i\u015fyerini etkileyebilecek zarar veya hasar verme potansiyelini,<\/p>\n<p>r) Tehlike s\u0131n\u0131f\u0131: \u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan, yap\u0131lan i\u015fin \u00f6zelli\u011fi, i\u015fin her safhas\u0131nda kullan\u0131lan veya ortaya \u00e7\u0131kan maddeler, i\u015f ekipman\u0131, \u00fcretim y\u00f6ntem ve \u015fekilleri, \u00e7al\u0131\u015fma ortam ve \u015fartlar\u0131 ile ilgili di\u011fer hususlar dikkate al\u0131narak i\u015fyeri i\u00e7in belirlenen tehlike grubunu,<\/p>\n<p>s) Teknik eleman: Teknik \u00f6\u011fretmen, fizik\u00e7i ve kimyager unvan\u0131na sahip olanlar ile \u00fcniversitelerin i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi program\u0131 mezunlar\u0131n\u0131,<\/p>\n<p>\u015f) \u0130\u015fyeri hem\u015firesi: 25\/2\/1954 tarihli ve 6283 say\u0131l\u0131 Hem\u015firelik Kanununa g\u00f6re hem\u015firelik mesle\u011fini icra etmeye yetkili, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi alan\u0131nda g\u00f6rev yapmak \u00fczere Bakanl\u0131k\u00e7a yetkilendirilmi\u015f i\u015fyeri hem\u015fireli\u011fi belgesine sahip hem\u015fire\/sa\u011fl\u0131k memurunu,<\/p>\n<p>ifade eder.<\/p>\n<p>(2) \u0130\u015fveren ad\u0131na hareket eden, i\u015fin ve i\u015fyerinin y\u00f6netiminde g\u00f6rev alan i\u015fveren vekilleri, bu Kanunun uygulanmas\u0131 bak\u0131m\u0131ndan i\u015fveren say\u0131l\u0131r.<\/p>\n<p><strong>\u0130<\/strong><strong>K<\/strong><strong>\u0130<\/strong><strong>NC<\/strong><strong>\u0130<\/strong><strong> B<\/strong><strong>\u00d6<\/strong><strong>L<\/strong><strong>\u00dc<\/strong><strong>M<\/strong><\/p>\n<p><strong>\u0130\u015f<\/strong><strong>veren ile <\/strong><strong>\u00c7<\/strong><strong>al<\/strong><strong>\u0131\u015f<\/strong><strong>anlar<\/strong><strong>\u0131<\/strong><strong>n G<\/strong><strong>\u00f6<\/strong><strong>rev, Yetki ve Y<\/strong><strong>\u00fc<\/strong><strong>k<\/strong><strong>\u00fc<\/strong><strong>ml<\/strong><strong>\u00fc<\/strong><strong>l<\/strong><strong>\u00fc<\/strong><strong>kleri<\/strong><\/p>\n<p><strong>\u0130\u015f<\/strong><strong>verenin genel y<\/strong><strong>\u00fc<\/strong><strong>k<\/strong><strong>\u00fc<\/strong><strong>ml<\/strong><strong>\u00fc<\/strong><strong>l<\/strong><strong>\u00fc\u011f\u00fc<\/strong><\/p>\n<p><strong>MADDE 4 <\/strong><strong>\u2013<\/strong> (1) \u0130\u015fveren, \u00e7al\u0131\u015fanlar\u0131n i\u015fle ilgili sa\u011fl\u0131k ve g\u00fcvenli\u011fini sa\u011flamakla y\u00fck\u00fcml\u00fc olup bu \u00e7er\u00e7evede;<\/p>\n<p>a) Mesleki risklerin \u00f6nlenmesi, e\u011fitim ve bilgi verilmesi d\u00e2hil her t\u00fcrl\u00fc tedbirin al\u0131nmas\u0131, organizasyonun yap\u0131lmas\u0131, gerekli ara\u00e7 ve gere\u00e7lerin sa\u011flanmas\u0131, sa\u011fl\u0131k ve g\u00fcvenlik tedbirlerinin de\u011fi\u015fen \u015fartlara uygun hale getirilmesi ve mevcut durumun iyile\u015ftirilmesi i\u00e7in \u00e7al\u0131\u015fmalar yapar.<\/p>\n<p>b) \u0130\u015fyerinde al\u0131nan i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi tedbirlerine uyulup uyulmad\u0131\u011f\u0131n\u0131 izler, denetler ve uygunsuzluklar\u0131n giderilmesini sa\u011flar.<\/p>\n<p>c) Risk de\u011ferlendirmesi yapar veya yapt\u0131r\u0131r.<\/p>\n<p>\u00e7) \u00c7al\u0131\u015fana g\u00f6rev verirken, \u00e7al\u0131\u015fan\u0131n sa\u011fl\u0131k ve g\u00fcvenlik y\u00f6n\u00fcnden i\u015fe uygunlu\u011funu g\u00f6z \u00f6n\u00fcne al\u0131r.<\/p>\n<p>d) Yeterli bilgi ve talimat verilenler d\u0131\u015f\u0131ndaki \u00e7al\u0131\u015fanlar\u0131n hayati ve \u00f6zel tehlike bulunan yerlere girmemesi i\u00e7in gerekli tedbirleri al\u0131r.<\/p>\n<p>(2) \u0130\u015fyeri d\u0131\u015f\u0131ndaki uzman ki\u015fi ve kurulu\u015flardan hizmet al\u0131nmas\u0131, i\u015fverenin sorumluluklar\u0131n\u0131 ortadan kald\u0131rmaz.<\/p>\n<p>(3) \u00c7al\u0131\u015fanlar\u0131n i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi alan\u0131ndaki y\u00fck\u00fcml\u00fcl\u00fckleri, i\u015fverenin sorumluluklar\u0131n\u0131 etkilemez.<\/p>\n<p>(4) \u0130\u015fveren, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi tedbirlerinin maliyetini \u00e7al\u0131\u015fanlara yans\u0131tamaz.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Risklerden korunma ilkeleri<\/strong><\/p>\n<p><strong>MADDE 5 <\/strong><strong>\u2013<\/strong> (1) \u0130\u015fverenin y\u00fck\u00fcml\u00fcl\u00fcklerinin yerine getirilmesinde a\u015fa\u011f\u0131daki ilkeler g\u00f6z \u00f6n\u00fcnde bulundurulur:<\/p>\n<p>a) Risklerden ka\u00e7\u0131nmak.<\/p>\n<p>b) Ka\u00e7\u0131n\u0131lmas\u0131 m\u00fcmk\u00fcn olmayan riskleri analiz etmek.<\/p>\n<p>c) Risklerle kayna\u011f\u0131nda m\u00fccadele etmek.<\/p>\n<p>\u00e7) \u0130\u015fin ki\u015filere uygun hale getirilmesi i\u00e7in i\u015fyerlerinin tasar\u0131m\u0131 ile i\u015f ekipman\u0131, \u00e7al\u0131\u015fma \u015fekli ve \u00fcretim metotlar\u0131n\u0131n se\u00e7iminde \u00f6zen g\u00f6stermek, \u00f6zellikle tekd\u00fcze \u00e7al\u0131\u015fma ve \u00fcretim temposunun sa\u011fl\u0131k ve g\u00fcvenli\u011fe olumsuz etkilerini \u00f6nlemek, \u00f6nlenemiyor ise en aza indirmek.<\/p>\n<p>d) Teknik geli\u015fmelere uyum sa\u011flamak.<\/p>\n<p>e) Tehlikeli olan\u0131, tehlikesiz veya daha az tehlikeli olanla de\u011fi\u015ftirmek.<\/p>\n<p>f) Teknoloji, i\u015f organizasyonu, \u00e7al\u0131\u015fma \u015fartlar\u0131, sosyal ili\u015fkiler ve \u00e7al\u0131\u015fma ortam\u0131 ile ilgili fakt\u00f6rlerin etkilerini kapsayan tutarl\u0131 ve genel bir \u00f6nleme politikas\u0131 geli\u015ftirmek.<\/p>\n<p>g) Toplu korunma tedbirlerine, ki\u015fisel korunma tedbirlerine g\u00f6re \u00f6ncelik vermek.<\/p>\n<p>\u011f) \u00c7al\u0131\u015fanlara uygun talimatlar vermek.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>\u0130\u015f<\/strong><strong> sa<\/strong><strong>\u011f<\/strong><strong>l<\/strong><strong>\u0131\u011f\u0131<\/strong><strong> ve g<\/strong><strong>\u00fc<\/strong><strong>venli<\/strong><strong>\u011f<\/strong><strong>i hizmetleri<\/strong><\/p>\n<p><strong>MADDE 6 <\/strong><strong>\u2013<\/strong> (1) Mesleki risklerin i\u00e7in i\u015fveren;<\/p>\n<p>a) \u00c7al\u0131\u015fanlar\u0131 aras\u0131ndan i\u015f g\u00fcvenli\u011fi uzman\u0131, i\u015fyeri hekimi ve di\u011fer sa\u011fl\u0131k personeli g\u00f6revlendirir. \u00c7al\u0131\u015fanlar\u0131 aras\u0131nda belirlenen niteliklere sahip personel bulunmamas\u0131 h\u00e2linde, bu hizmetin tamam\u0131n\u0131 veya bir k\u0131sm\u0131n\u0131 ortak sa\u011fl\u0131k ve g\u00fcvenlik birimlerinden hizmet alarak yerine getirebilir. Ancak belirlenen niteliklere ve gerekli belgeye sahip olmas\u0131 h\u00e2linde, tehlike s\u0131n\u0131f\u0131 ve \u00e7al\u0131\u015fan say\u0131s\u0131 dikkate al\u0131narak, bu hizmetin yerine getirilmesini kendisi \u00fcstlenebilir.<\/p>\n<p>b) G\u00f6revlendirdikleri ki\u015fi veya hizmet ald\u0131\u011f\u0131 kurum ve kurulu\u015flar\u0131n g\u00f6revlerini yerine getirmeleri amac\u0131yla ara\u00e7, gere\u00e7, mek\u00e2n ve zaman gibi gerekli b\u00fct\u00fcn ihtiya\u00e7lar\u0131n\u0131 kar\u015f\u0131lar.<\/p>\n<p>c) \u0130\u015fyerinde sa\u011fl\u0131k ve g\u00fcvenlik hizmetlerini y\u00fcr\u00fctenler aras\u0131nda i\u015f birli\u011fi ve koordinasyonu sa\u011flar.<\/p>\n<p>\u00e7) G\u00f6revlendirdikleri ki\u015fi veya hizmet ald\u0131\u011f\u0131 kurum ve kurulu\u015flar taraf\u0131ndan i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi ile ilgili mevzuata uygun olan ve yaz\u0131l\u0131 olarak bildirilen tedbirleri yerine getirir.<\/p>\n<p>d) \u00c7al\u0131\u015fanlar\u0131n sa\u011fl\u0131k ve g\u00fcvenli\u011fini etkiledi\u011fi bilinen veya etkilemesi muhtemel konular hakk\u0131nda; g\u00f6revlendirdikleri ki\u015fi veya hizmet ald\u0131\u011f\u0131 kurum ve kurulu\u015flar\u0131, ba\u015fka i\u015fyerlerinden \u00e7al\u0131\u015fmak \u00fczere kendi i\u015fyerine gelen \u00e7al\u0131\u015fanlar\u0131 ve bunlar\u0131n i\u015fverenlerini bilgilendirir.<\/p>\n<p>(2) 4\/1\/2002 tarihli ve 4734 say\u0131l\u0131 Kamu \u0130hale Kanunu kapsam\u0131ndaki kamu kurum ve kurulu\u015flar\u0131; i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi hizmetlerini, Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131na ait d\u00f6ner sermayeli kurulu\u015flardan do\u011frudan alabilece\u011fi gibi 4734 say\u0131l\u0131 Kanun h\u00fck\u00fcmleri \u00e7er\u00e7evesinde de alabilir.<\/p>\n<p>(3) Tam s\u00fcreli i\u015fyeri hekimi g\u00f6revlendirilen i\u015fyerlerinde, di\u011fer sa\u011fl\u0131k personeli g\u00f6revlendirilmesi zorunlu de\u011fildir.<\/p>\n<p><strong>\u0130\u015f<\/strong><strong> sa<\/strong><strong>\u011f<\/strong><strong>l<\/strong><strong>\u0131\u011f\u0131<\/strong><strong> ve g<\/strong><strong>\u00fc<\/strong><strong>venli<\/strong><strong>\u011f<\/strong><strong>i hizmetlerinin desteklenmesi<\/strong><\/p>\n<p><strong>MADDE 7 <\/strong><strong>\u2013<\/strong> (1) \u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi hizmetlerinin yerine getirilmesi i\u00e7in, Bakanl\u0131k\u00e7a a\u015fa\u011f\u0131daki \u015fartlarla destek sa\u011flanabilir:<\/p>\n<p>a) Kamu kurum ve kurulu\u015flar\u0131 hari\u00e7 ondan az \u00e7al\u0131\u015fan\u0131 bulunanlardan, \u00e7ok tehlikeli ve tehlikeli s\u0131n\u0131fta yer alan i\u015fyerleri faydalanabilir. Ancak, Bakanlar Kurulu, ondan az \u00e7al\u0131\u015fan\u0131 bulunanlardan az tehlikeli s\u0131n\u0131fta yer alan i\u015fyerlerinin de faydalanmas\u0131na karar verebilir.<\/p>\n<p>b) Giderler, i\u015f kazas\u0131 ve meslek hastal\u0131\u011f\u0131 bak\u0131m\u0131ndan k\u0131sa vadeli sigorta kollar\u0131 i\u00e7in toplanan primlerden kaynak aktar\u0131lmak suretiyle, Sosyal G\u00fcvenlik Kurumu taraf\u0131ndan finanse edilir.<\/p>\n<p>c) Uygulamada, Sosyal G\u00fcvenlik Kurumu kay\u0131tlar\u0131 esas al\u0131n\u0131r.<\/p>\n<p>\u00e7) Bu Kanun ve di\u011fer mevzuat gere\u011fince yap\u0131lan kontrol ve denetimlerde; istihdam etti\u011fi ki\u015filerin sigortal\u0131l\u0131k bildiriminde bulunmad\u0131\u011f\u0131 tespit edilen i\u015fverenlerden, tespit tarihine kadar yap\u0131lan \u00f6demeler yasal faizi ile birlikte Sosyal G\u00fcvenlik Kurumunca tahsil edilir ve bu durumdaki i\u015fverenler, sa\u011flanan destekten \u00fc\u00e7 y\u0131l s\u00fcreyle faydalanamaz.<\/p>\n<p>d) Uygulamaya ili\u015fkin olarak ortaya \u00e7\u0131kabilecek teredd\u00fctleri gidermeye, uygulamay\u0131 y\u00f6nlendirmeye ve do\u011fabilecek sorunlar\u0131 \u00e7\u00f6zmeye Bakanl\u0131k yetkilidir.<\/p>\n<p>(2) A\u015fa\u011f\u0131daki konular ile bunlara ili\u015fkin usul ve esaslar, Maliye Bakanl\u0131\u011f\u0131n\u0131n uygun g\u00f6r\u00fc\u015f\u00fc al\u0131narak Bakanl\u0131k\u00e7a \u00e7\u0131kar\u0131lan y\u00f6netmelikle belirlenir:<\/p>\n<p>a) \u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi hizmetlerinin yerine getirilmesi i\u00e7in sa\u011flanacak deste\u011fin uygulanmas\u0131.<\/p>\n<p>b) Destek sa\u011flanacak ondan az \u00e7al\u0131\u015fan\u0131 bulunan i\u015fyerlerinin \u00f6zellikleri g\u00f6z \u00f6n\u00fcnde bulundurularak; Sosyal G\u00fcvenlik Kurumu taraf\u0131ndan \u00f6denecek i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi hizmet bedellerinin tespiti, destek olunacak k\u0131sm\u0131 ve \u00f6denme \u015fekli.<\/p>\n<p>c) Destekten faydalanabilecek i\u015fyerlerinin ta\u015f\u0131mas\u0131 gereken \u015fartlar.<\/p>\n<p>\u00e7) \u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi hizmeti verecek kurulu\u015flar\u0131n \u00f6zellikleri.<\/p>\n<p>(3) Etkinlik ve s\u00fcreklili\u011fin sa\u011flanmas\u0131 amac\u0131yla; Bakanl\u0131k taraf\u0131ndan Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131, Bilim, Sanayi ve Teknoloji Bakanl\u0131\u011f\u0131 ve ilgili meslek kurulu\u015flar\u0131yla i\u015f birli\u011fi yap\u0131labilir.<\/p>\n<p><strong>\u0130\u015f<\/strong><strong>yeri hekimleri ve i<\/strong><strong>\u015f<\/strong><strong> g<\/strong><strong>\u00fc<\/strong><strong>venli<\/strong><strong>\u011f<\/strong><strong>i uzmanlar<\/strong><strong>\u0131<\/strong><\/p>\n<p><strong>MADDE 8 <\/strong><strong>\u2013<\/strong> (1) \u0130\u015fyeri hekimi ve i\u015f g\u00fcvenli\u011fi uzmanlar\u0131n\u0131n hak ve yetkileri, g\u00f6revlerini yerine getirmeleri nedeniyle k\u0131s\u0131tlanamaz. Bu ki\u015filer, g\u00f6revlerini mesle\u011fin gerektirdi\u011fi etik ilkeler ve mesleki ba\u011f\u0131ms\u0131zl\u0131k i\u00e7erisinde y\u00fcr\u00fct\u00fcr.<\/p>\n<p>(2) \u0130\u015fyeri hekimi ve i\u015f g\u00fcvenli\u011fi uzmanlar\u0131; g\u00f6revlendirildikleri i\u015fyerlerinde i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fiyle ilgili al\u0131nmas\u0131 gereken tedbirleri i\u015fverene yaz\u0131l\u0131 olarak bildirir; bildirilen hususlardan hayati tehlike arz edenlerin i\u015fveren taraf\u0131ndan yerine getirilmemesi h\u00e2linde, bu hususu Bakanl\u0131\u011f\u0131n yetkili birimine bildirir.<\/p>\n<p>(3) Hizmet sunan kurulu\u015flar ile i\u015fyeri hekimi ve i\u015f g\u00fcvenli\u011fi uzmanlar\u0131, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi hizmetlerinin y\u00fcr\u00fct\u00fclmesindeki ihmallerinden dolay\u0131, hizmet sunduklar\u0131 i\u015fverene kar\u015f\u0131 sorumludur.<\/p>\n<p>(4) \u00c7al\u0131\u015fan\u0131n \u00f6l\u00fcm\u00fc veya maluliyetiyle sonu\u00e7lanacak \u015fekilde v\u00fccut b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fcn bozulmas\u0131na neden olan i\u015f kazas\u0131 veya meslek hastal\u0131\u011f\u0131n\u0131n meydana gelmesinde ihmali tespit edilen i\u015fyeri hekimi veya i\u015f g\u00fcvenli\u011fi uzman\u0131n\u0131n yetki belgesi ask\u0131ya al\u0131n\u0131r.<\/p>\n<p>(5) \u0130\u015f g\u00fcvenli\u011fi uzmanlar\u0131n\u0131n g\u00f6rev alabilmeleri i\u00e7in; \u00e7ok tehlikeli s\u0131n\u0131fta yer alan i\u015fyerlerinde (A) s\u0131n\u0131f\u0131, tehlikeli s\u0131n\u0131fta yer alan i\u015fyerlerinde en az (B) s\u0131n\u0131f\u0131, az tehlikeli s\u0131n\u0131fta yer alan i\u015fyerlerinde ise en az (C) s\u0131n\u0131f\u0131 i\u015f g\u00fcvenli\u011fi uzmanl\u0131\u011f\u0131 belgesine sahip olmalar\u0131 \u015fart\u0131 aran\u0131r. Bakanl\u0131k, i\u015f g\u00fcvenli\u011fi uzmanlar\u0131n\u0131n ve i\u015fyeri hekimlerinin g\u00f6revlendirilmesi konusunda sekt\u00f6rel alanda \u00f6zel d\u00fczenleme yapabilir.<\/p>\n<p>(6) Belirlenen \u00e7al\u0131\u015fma s\u00fcresi nedeniyle i\u015fyeri hekimi ve i\u015f g\u00fcvenli\u011fi uzman\u0131n\u0131n tam s\u00fcreli g\u00f6revlendirilmesi gereken durumlarda; i\u015fveren, i\u015fyeri sa\u011fl\u0131k ve g\u00fcvenlik birimi kurar. Bu durumda, \u00e7al\u0131\u015fanlar\u0131n tabi oldu\u011fu kanun h\u00fck\u00fcmleri sakl\u0131 kalmak kayd\u0131yla, 22\/5\/2003 tarihli ve 4857 say\u0131l\u0131 \u0130\u015f Kanununa g\u00f6re belirlenen haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresi dikkate al\u0131n\u0131r.<\/p>\n<p>(7) Kamu kurum ve kurulu\u015flar\u0131nda ilgili mevzuata g\u00f6re \u00e7al\u0131\u015ft\u0131r\u0131lan i\u015fyeri hekimi veya i\u015f g\u00fcvenli\u011fi uzman\u0131 olma niteli\u011fini haiz personel, gerekli belgeye sahip olmalar\u0131 \u015fart\u0131yla asli g\u00f6revlerinin yan\u0131nda, belirlenen \u00e7al\u0131\u015fma s\u00fcresine riayet ederek \u00e7al\u0131\u015fmakta olduklar\u0131 kurumda veya ilgili personelin muvafakati ve \u00fcst y\u00f6neticinin onay\u0131 ile di\u011fer kamu kurum ve kurulu\u015flar\u0131nda g\u00f6revlendirilebilir. Bu \u015fekilde g\u00f6revlendirilecek personele, g\u00f6rev yapt\u0131\u011f\u0131 her saat i\u00e7in (200) g\u00f6sterge rakam\u0131n\u0131n memur ayl\u0131k katsay\u0131s\u0131 ile \u00e7arp\u0131m\u0131 tutar\u0131nda ilave \u00f6deme, hizmet alan kurum taraf\u0131ndan yap\u0131l\u0131r. Bu \u00f6demeden damga vergisi hari\u00e7 herhangi bir kesinti yap\u0131lmaz. Bu durumdaki g\u00f6revlendirmeye ili\u015fkin ilave \u00f6demelerde, g\u00fcnl\u00fck mesai saatlerine ba\u011fl\u0131 kalmak kayd\u0131yla, ayl\u0131k toplam seksen saatten fazla olan g\u00f6revlendirmeler dikkate al\u0131nmaz.<\/p>\n<p>(8) Kamu sa\u011fl\u0131k hizmetlerinde tam s\u00fcreli \u00e7al\u0131\u015fmaya ili\u015fkin mevzuat h\u00fck\u00fcmleri sakl\u0131 kalmak kayd\u0131yla, i\u015fyeri hekimlerinin ve di\u011fer sa\u011fl\u0131k personelinin i\u015fyeri sa\u011fl\u0131k ve g\u00fcvenlik birimi ile ortak sa\u011fl\u0131k ve g\u00fcvenlik birimlerinde g\u00f6revlendirilmelerinde ve hizmet verilen i\u015fyerlerinde \u00e7al\u0131\u015fanlarla s\u0131n\u0131rl\u0131 olmak \u00fczere g\u00f6revlerini yerine getirmelerinde, di\u011fer kanunlar\u0131n k\u0131s\u0131tlay\u0131c\u0131 h\u00fck\u00fcmleri uygulanmaz.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Tehlike s<\/strong><strong>\u0131<\/strong><strong>n<\/strong><strong>\u0131<\/strong><strong>f<\/strong><strong>\u0131<\/strong><strong>n<\/strong><strong>\u0131<\/strong><strong>n belirlenmesi<\/strong><\/p>\n<p><strong>MADDE 9 <\/strong><strong>\u2013<\/strong> (1) \u0130\u015fyeri tehlike s\u0131n\u0131flar\u0131; 31\/5\/2006 tarihli ve 5510 say\u0131l\u0131 Sosyal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131 Kanununun 83 \u00fcnc\u00fc maddesine g\u00f6re belirlenen k\u0131sa vadeli sigorta kollar\u0131 prim tarifesi de dikkate al\u0131narak, \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Genel M\u00fcd\u00fcr\u00fcn\u00fcn Ba\u015fkanl\u0131\u011f\u0131nda ilgili taraflarca olu\u015fturulan komisyonun g\u00f6r\u00fc\u015fleri do\u011frultusunda, Bakanl\u0131k\u00e7a \u00e7\u0131kar\u0131lacak tebli\u011f ile tespit edilir.<\/p>\n<p>(2) \u0130\u015fyeri tehlike s\u0131n\u0131flar\u0131n\u0131n tespitinde, o i\u015fyerinde yap\u0131lan as\u0131l i\u015f dikkate al\u0131n\u0131r.<\/p>\n<p><strong>Risk de<\/strong><strong>\u011f<\/strong><strong>erlendirmesi, kontrol, <\/strong><strong>\u00f6<\/strong><strong>l<\/strong><strong>\u00e7\u00fc<\/strong><strong>m ve ara<\/strong><strong>\u015f<\/strong><strong>t<\/strong><strong>\u0131<\/strong><strong>rma<\/strong><\/p>\n<p><strong>MADDE 10 <\/strong><strong>\u2013<\/strong> (1) \u0130\u015fveren, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi y\u00f6n\u00fcnden risk de\u011ferlendirmesi yapmak veya yapt\u0131rmakla y\u00fck\u00fcml\u00fcd\u00fcr. Risk de\u011ferlendirmesi yap\u0131l\u0131rken a\u015fa\u011f\u0131daki hususlar dikkate al\u0131n\u0131r:<\/p>\n<p>a) Belirli risklerden etkilenecek \u00e7al\u0131\u015fanlar\u0131n durumu.<\/p>\n<p>b) Kullan\u0131lacak i\u015f ekipman\u0131 ile kimyasal madde ve m\u00fcstahzarlar\u0131n se\u00e7imi.<\/p>\n<p>c) \u0130\u015fyerinin tertip ve d\u00fczeni.<\/p>\n<p>\u00e7) Gen\u00e7, ya\u015fl\u0131, engelli, gebe veya emziren \u00e7al\u0131\u015fanlar gibi \u00f6zel politika gerektiren gruplar ile kad\u0131n \u00e7al\u0131\u015fanlar\u0131n durumu.<\/p>\n<p>(2) \u0130\u015fveren, yap\u0131lacak risk de\u011ferlendirmesi sonucu al\u0131nacak i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi tedbirleri ile kullan\u0131lmas\u0131 gereken koruyucu donan\u0131m veya ekipman\u0131 belirler.<\/p>\n<p>(3) \u0130\u015fyerinde uygulanacak i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi tedbirleri, \u00e7al\u0131\u015fma \u015fekilleri ve \u00fcretim y\u00f6ntemleri; \u00e7al\u0131\u015fanlar\u0131n sa\u011fl\u0131k ve g\u00fcvenlik y\u00f6n\u00fcnden korunma d\u00fczeyini y\u00fckseltecek ve i\u015fyerinin idari yap\u0131lanmas\u0131n\u0131n her kademesinde uygulanabilir nitelikte olmal\u0131d\u0131r.<\/p>\n<p>(4) \u0130\u015fveren, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi y\u00f6n\u00fcnden \u00e7al\u0131\u015fma ortam\u0131na ve \u00e7al\u0131\u015fanlar\u0131n bu ortamda maruz kald\u0131\u011f\u0131 risklerin belirlenmesine y\u00f6nelik gerekli kontrol, \u00f6l\u00e7\u00fcm, inceleme ve ara\u015ft\u0131rmalar\u0131n yap\u0131lmas\u0131n\u0131 sa\u011flar.<\/p>\n<p><strong>Acil durum planlar<\/strong><strong>\u0131<\/strong><strong>, yang<\/strong><strong>\u0131<\/strong><strong>nla m<\/strong><strong>\u00fc<\/strong><strong>cadele ve ilk yard<\/strong><strong>\u0131<\/strong><strong>m<\/strong><\/p>\n<p><strong>MADDE 11 <\/strong><strong>\u2013<\/strong> (1) \u0130\u015fveren;<\/p>\n<p>a) \u00c7al\u0131\u015fma ortam\u0131, kullan\u0131lan maddeler, i\u015f ekipman\u0131 ile \u00e7evre \u015fartlar\u0131n\u0131 dikkate alarak meydana gelebilecek acil durumlar\u0131 \u00f6nceden de\u011ferlendirerek, \u00e7al\u0131\u015fanlar\u0131 ve \u00e7al\u0131\u015fma \u00e7evresini etkilemesi m\u00fcmk\u00fcn ve muhtemel acil durumlar\u0131 belirler ve bunlar\u0131n olumsuz etkilerini \u00f6nleyici ve s\u0131n\u0131rland\u0131r\u0131c\u0131 tedbirleri al\u0131r.<\/p>\n<p>b) Acil durumlar\u0131n olumsuz etkilerinden korunmak \u00fczere gerekli \u00f6l\u00e7\u00fcm ve de\u011ferlendirmeleri yapar, acil durum planlar\u0131n\u0131 haz\u0131rlar.<\/p>\n<p>c) Acil durumlarla m\u00fccadele i\u00e7in i\u015fyerinin b\u00fcy\u00fckl\u00fc\u011f\u00fc ve ta\u015f\u0131d\u0131\u011f\u0131 \u00f6zel tehlikeler, yap\u0131lan i\u015fin niteli\u011fi, \u00e7al\u0131\u015fan say\u0131s\u0131 ile i\u015fyerinde bulunan di\u011fer ki\u015fileri dikkate alarak; \u00f6nleme, koruma, tahliye, yang\u0131nla m\u00fccadele, ilk yard\u0131m ve benzeri konularda uygun donan\u0131ma sahip ve bu konularda e\u011fitimli yeterli say\u0131da ki\u015fiyi g\u00f6revlendirir, ara\u00e7 ve gere\u00e7leri sa\u011flayarak e\u011fitim ve tatbikatlar\u0131 yapt\u0131r\u0131r ve ekiplerin her zaman haz\u0131r bulunmalar\u0131n\u0131 sa\u011flar.<\/p>\n<p>\u00e7) \u00d6zellikle ilk yard\u0131m, acil t\u0131bbi m\u00fcdahale, kurtarma ve yang\u0131nla m\u00fccadele konular\u0131nda, i\u015fyeri d\u0131\u015f\u0131ndaki kurulu\u015flarla irtibat\u0131 sa\u011flayacak gerekli d\u00fczenlemeleri yapar.<\/p>\n<p><strong>Tahliye<\/strong><\/p>\n<p><strong>MADDE 12 <\/strong><strong>\u2013<\/strong> (1) Ciddi, yak\u0131n ve \u00f6nlenemeyen tehlikenin meydana gelmesi durumunda i\u015fveren;<\/p>\n<p>a) \u00c7al\u0131\u015fanlar\u0131n i\u015fi b\u0131rakarak derhal \u00e7al\u0131\u015fma yerlerinden ayr\u0131l\u0131p g\u00fcvenli bir yere gidebilmeleri i\u00e7in, \u00f6nceden gerekli d\u00fczenlemeleri yapar ve \u00e7al\u0131\u015fanlara gerekli talimatlar\u0131 verir.<\/p>\n<p>b) Durumun devam etmesi h\u00e2linde, zorunluluk olmad\u0131k\u00e7a, gerekli donan\u0131ma sahip ve \u00f6zel olarak g\u00f6revlendirilenler d\u0131\u015f\u0131ndaki \u00e7al\u0131\u015fanlardan i\u015flerine devam etmelerini isteyemez.<\/p>\n<p>(2) \u0130\u015fveren, \u00e7al\u0131\u015fanlar\u0131n kendileri veya di\u011fer ki\u015filerin g\u00fcvenli\u011fi i\u00e7in ciddi ve yak\u0131n bir tehlike ile kar\u015f\u0131la\u015ft\u0131klar\u0131 ve amirine hemen haber veremedikleri durumlarda; istenmeyen sonu\u00e7lar\u0131n \u00f6nlenmesi i\u00e7in, bilgileri ve mevcut teknik donan\u0131mlar\u0131 \u00e7er\u00e7evesinde m\u00fcdahale edebilmelerine imk\u00e2n sa\u011flar. B\u00f6yle bir durumda \u00e7al\u0131\u015fanlar, ihmal veya dikkatsiz davran\u0131\u015flar\u0131 olmad\u0131k\u00e7a yapt\u0131klar\u0131 m\u00fcdahaleden dolay\u0131 sorumlu tutulamaz.<\/p>\n<p><strong>\u00c7<\/strong><strong>al<\/strong><strong>\u0131\u015f<\/strong><strong>maktan<\/strong><strong> ka<\/strong><strong>\u00e7\u0131<\/strong><strong>nma hakk<\/strong><strong>\u0131<\/strong><\/p>\n<p><strong>MADDE 13 <\/strong><strong>\u2013<\/strong> (1) Ciddi ve yak\u0131n tehlike ile kar\u015f\u0131 kar\u015f\u0131ya kalan \u00e7al\u0131\u015fanlar kurula, kurulun bulunmad\u0131\u011f\u0131 i\u015fyerlerinde ise i\u015fverene ba\u015fvurarak durumun tespit edilmesini ve gerekli tedbirlerin al\u0131nmas\u0131na karar verilmesini talep edebilir. Kurul acilen toplanarak, i\u015fveren ise derh\u00e2l karar\u0131n\u0131 verir ve durumu tutanakla tespit eder. Karar, \u00e7al\u0131\u015fana ve \u00e7al\u0131\u015fan temsilcisine yaz\u0131l\u0131 olarak bildirilir.<\/p>\n<p>(2) Kurul veya i\u015fverenin \u00e7al\u0131\u015fan\u0131n talebi y\u00f6n\u00fcnde karar vermesi h\u00e2linde \u00e7al\u0131\u015fan, gerekli tedbirler al\u0131n\u0131ncaya kadar \u00e7al\u0131\u015fmaktan ka\u00e7\u0131nabilir. \u00c7al\u0131\u015fanlar\u0131n \u00e7al\u0131\u015fmaktan ka\u00e7\u0131nd\u0131\u011f\u0131 d\u00f6nemdeki \u00fccreti ile kanunlardan ve i\u015f s\u00f6zle\u015fmesinden do\u011fan di\u011fer haklar\u0131 sakl\u0131d\u0131r.<\/p>\n<p>(3) \u00c7al\u0131\u015fanlar ciddi ve yak\u0131n tehlikenin \u00f6nlenemez oldu\u011fu durumlarda birinci f\u0131kradaki usule uymak zorunda olmaks\u0131z\u0131n i\u015fyerini veya tehlikeli b\u00f6lgeyi terk ederek belirlenen g\u00fcvenli yere gider. \u00c7al\u0131\u015fanlar\u0131n bu hareketlerinden dolay\u0131 haklar\u0131 k\u0131s\u0131tlanamaz.<\/p>\n<p>(4) \u0130\u015f s\u00f6zle\u015fmesiyle \u00e7al\u0131\u015fanlar, talep etmelerine ra\u011fmen gerekli tedbirlerin al\u0131nmad\u0131\u011f\u0131 durumlarda, tabi olduklar\u0131 kanun h\u00fck\u00fcmlerine g\u00f6re i\u015f s\u00f6zle\u015fmelerini feshedebilir. Toplu s\u00f6zle\u015fme veya toplu i\u015f s\u00f6zle\u015fmesi ile \u00e7al\u0131\u015fan kamu personeli, bu maddeye g\u00f6re \u00e7al\u0131\u015fmad\u0131\u011f\u0131 d\u00f6nemde fiilen \u00e7al\u0131\u015fm\u0131\u015f say\u0131l\u0131r.<\/p>\n<p>(5) Bu Kanunun 25 inci maddesine g\u00f6re i\u015fyerinde i\u015fin durdurulmas\u0131 h\u00e2linde, bu madde h\u00fck\u00fcmleri uygulanmaz.<\/p>\n<p><strong>\u0130\u015f<\/strong><strong> kazas<\/strong><strong>\u0131<\/strong><strong> ve meslek hastal<\/strong><strong>\u0131<\/strong><strong>klar<\/strong><strong>\u0131<\/strong><strong>n<\/strong><strong>\u0131<\/strong><strong>n kay<\/strong><strong>\u0131<\/strong><strong>t ve bildirimi<\/strong><\/p>\n<p><strong>MADDE 14 <\/strong><strong>\u2013<\/strong> (1) \u0130\u015fveren;<\/p>\n<p>a) B\u00fct\u00fcn i\u015f kazalar\u0131n\u0131n ve meslek hastal\u0131klar\u0131n\u0131n kayd\u0131n\u0131 tutar, gerekli incelemeleri yaparak bunlar ile ilgili raporlar\u0131 d\u00fczenler.<\/p>\n<p>b) \u0130\u015fyerinde meydana gelen ancak yaralanma veya \u00f6l\u00fcme neden olmad\u0131\u011f\u0131 halde i\u015fyeri ya da i\u015f ekipman\u0131n\u0131n zarara u\u011framas\u0131na yol a\u00e7an veya \u00e7al\u0131\u015fan, i\u015fyeri ya da i\u015f ekipman\u0131n\u0131 zarara u\u011fratma potansiyeli olan olaylar\u0131 inceleyerek bunlar ile ilgili raporlar\u0131 d\u00fczenler.<\/p>\n<p>(2) \u0130\u015fveren, a\u015fa\u011f\u0131daki hallerde belirtilen s\u00fcrede Sosyal G\u00fcvenlik Kurumuna bildirimde bulunur:<\/p>\n<p>a) \u0130\u015f kazalar\u0131n\u0131 kazadan sonraki \u00fc\u00e7 i\u015f g\u00fcn\u00fc i\u00e7inde.<\/p>\n<p>b) Sa\u011fl\u0131k hizmeti sunucular\u0131 veya i\u015fyeri hekimi taraf\u0131ndan kendisine bildirilen meslek hastal\u0131klar\u0131n\u0131, \u00f6\u011frendi\u011fi tarihten itibaren \u00fc\u00e7 i\u015f g\u00fcn\u00fc i\u00e7inde.<\/p>\n<p>(3) \u0130\u015fyeri hekimi veya sa\u011fl\u0131k hizmeti sunucular\u0131; meslek hastal\u0131\u011f\u0131 \u00f6n tan\u0131s\u0131 koyduklar\u0131 vakalar\u0131, Sosyal G\u00fcvenlik Kurumu taraf\u0131ndan yetkilendirilen sa\u011fl\u0131k hizmeti sunucular\u0131na sevk eder.<\/p>\n<p>(4) Sa\u011fl\u0131k hizmeti sunucular\u0131 kendilerine intikal eden i\u015f kazalar\u0131n\u0131, yetkilendirilen sa\u011fl\u0131k hizmeti sunucular\u0131 ise meslek hastal\u0131\u011f\u0131 tan\u0131s\u0131 koyduklar\u0131 vakalar\u0131 en ge\u00e7 on g\u00fcn i\u00e7inde Sosyal G\u00fcvenlik Kurumuna bildirir.<\/p>\n<p>(5) Bu maddenin uygulanmas\u0131na ili\u015fkin usul ve esaslar, Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131n\u0131n uygun g\u00f6r\u00fc\u015f\u00fc al\u0131narak Bakanl\u0131k\u00e7a belirlenir.<\/p>\n<p><strong>Sa<\/strong><strong>\u011f<\/strong><strong>l<\/strong><strong>\u0131<\/strong><strong>k g<\/strong><strong>\u00f6<\/strong><strong>zetimi<\/strong><\/p>\n<p><strong>MADDE 15 <\/strong><strong>\u2013<\/strong> (1) \u0130\u015fveren;<\/p>\n<p>a) \u00c7al\u0131\u015fanlar\u0131n i\u015fyerinde maruz kalacaklar\u0131 sa\u011fl\u0131k ve g\u00fcvenlik risklerini dikkate alarak sa\u011fl\u0131k g\u00f6zetimine tabi tutulmalar\u0131n\u0131 sa\u011flar.<\/p>\n<p>b) A\u015fa\u011f\u0131daki hallerde \u00e7al\u0131\u015fanlar\u0131n sa\u011fl\u0131k muayenelerinin yap\u0131lmas\u0131n\u0131 sa\u011flamak zorundad\u0131r:<\/p>\n<p>1) \u0130\u015fe giri\u015flerinde.<\/p>\n<p>2) \u0130\u015f de\u011fi\u015fikli\u011finde.<\/p>\n<p>3) \u0130\u015f kazas\u0131, meslek hastal\u0131\u011f\u0131 veya sa\u011fl\u0131k nedeniyle tekrarlanan i\u015ften uzakla\u015fmalar\u0131ndan sonra i\u015fe d\u00f6n\u00fc\u015flerinde talep etmeleri h\u00e2linde.<\/p>\n<p>4) \u0130\u015fin devam\u0131 s\u00fcresince, \u00e7al\u0131\u015fan\u0131n ve i\u015fin niteli\u011fi ile i\u015fyerinin tehlike s\u0131n\u0131f\u0131na g\u00f6re Bakanl\u0131k\u00e7a belirlenen d\u00fczenli aral\u0131klarla.<\/p>\n<p>(2) Tehlikeli ve \u00e7ok tehlikeli s\u0131n\u0131fta yer alan i\u015fyerlerinde \u00e7al\u0131\u015facaklar, yapacaklar\u0131 i\u015fe uygun olduklar\u0131n\u0131 belirten sa\u011fl\u0131k raporu olmadan i\u015fe ba\u015flat\u0131lamaz.<\/p>\n<p>(3) Bu Kanun kapsam\u0131nda al\u0131nmas\u0131 gereken sa\u011fl\u0131k raporlar\u0131, i\u015fyeri sa\u011fl\u0131k ve g\u00fcvenlik biriminde veya hizmet al\u0131nan ortak sa\u011fl\u0131k ve g\u00fcvenlik biriminde g\u00f6revli olan i\u015fyeri hekiminden al\u0131n\u0131r. Raporlara itirazlar Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131 taraf\u0131ndan belirlenen hakem hastanelere yap\u0131l\u0131r, verilen kararlar kesindir.<\/p>\n<p>(4) Sa\u011fl\u0131k g\u00f6zetiminden do\u011fan maliyet ve bu g\u00f6zetimden kaynakl\u0131 her t\u00fcrl\u00fc ek maliyet i\u015fverence kar\u015f\u0131lan\u0131r, \u00e7al\u0131\u015fana yans\u0131t\u0131lamaz.<\/p>\n<p>(5) Sa\u011fl\u0131k muayenesi yapt\u0131r\u0131lan \u00e7al\u0131\u015fan\u0131n \u00f6zel hayat\u0131 ve itibar\u0131n\u0131n korunmas\u0131 a\u00e7\u0131s\u0131ndan sa\u011fl\u0131k bilgileri gizli tutulur.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>\u00c7<\/strong><strong>al<\/strong><strong>\u0131\u015f<\/strong><strong>anlar<\/strong><strong>\u0131<\/strong><strong>n bilgilendirilmesi<\/strong><\/p>\n<p><strong>MADDE 16 <\/strong><strong>\u2013<\/strong> (1) \u0130\u015fyerinde i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011finin sa\u011flanmas\u0131 ve s\u00fcrd\u00fcr\u00fclebilmesi amac\u0131yla i\u015fveren, \u00e7al\u0131\u015fanlar\u0131 ve \u00e7al\u0131\u015fan temsilcilerini i\u015fyerinin \u00f6zelliklerini de dikkate alarak a\u015fa\u011f\u0131daki konularda bilgilendirir:<\/p>\n<p>a) \u0130\u015fyerinde kar\u015f\u0131la\u015f\u0131labilecek sa\u011fl\u0131k ve g\u00fcvenlik riskleri, koruyucu ve \u00f6nleyici tedbirler.<\/p>\n<p>b) Kendileri ile ilgili yasal hak ve sorumluluklar.<\/p>\n<p>c) \u0130lk yard\u0131m, ola\u011fan d\u0131\u015f\u0131 durumlar, afetler ve yang\u0131nla m\u00fccadele ve tahliye i\u015fleri konusunda g\u00f6revlendirilen ki\u015filer.<\/p>\n<p>(2) \u0130\u015fveren;<\/p>\n<p>a) 12 nci maddede belirtilen ciddi ve yak\u0131n tehlikeye maruz kalan veya kalma riski olan b\u00fct\u00fcn \u00e7al\u0131\u015fanlar\u0131, tehlikeler ile bunlardan do\u011fan risklere kar\u015f\u0131 al\u0131nm\u0131\u015f ve al\u0131nacak tedbirler hakk\u0131nda derhal bilgilendirir.<\/p>\n<p>b) Ba\u015fka i\u015fyerlerinden \u00e7al\u0131\u015fmak \u00fczere kendi i\u015fyerine gelen \u00e7al\u0131\u015fanlar\u0131n birinci f\u0131krada belirtilen bilgileri almalar\u0131n\u0131 sa\u011flamak \u00fczere, s\u00f6z konusu \u00e7al\u0131\u015fanlar\u0131n i\u015fverenlerine gerekli bilgileri verir.<\/p>\n<p>c) Risk de\u011ferlendirmesi, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi ile ilgili koruyucu ve \u00f6nleyici tedbirler, \u00f6l\u00e7\u00fcm, analiz, teknik kontrol, kay\u0131tlar, raporlar ve tefti\u015ften elde edilen bilgilere, destek elemanlar\u0131 ile \u00e7al\u0131\u015fan temsilcilerinin ula\u015fmas\u0131n\u0131 sa\u011flar.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>\u00c7<\/strong><strong>al<\/strong><strong>\u0131\u015f<\/strong><strong>anlar<\/strong><strong>\u0131<\/strong><strong>n e<\/strong><strong>\u011f<\/strong><strong>itimi<\/strong><\/p>\n<p><strong>MADDE 17 <\/strong><strong>\u2013<\/strong> (1) \u0130\u015fveren, \u00e7al\u0131\u015fanlar\u0131n i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi e\u011fitimlerini almas\u0131n\u0131 sa\u011flar. Bu e\u011fitim \u00f6zellikle; i\u015fe ba\u015flamadan \u00f6nce, \u00e7al\u0131\u015fma yeri veya i\u015f de\u011fi\u015fikli\u011finde, i\u015f ekipman\u0131n\u0131n de\u011fi\u015fmesi h\u00e2linde veya yeni teknoloji uygulanmas\u0131 h\u00e2linde verilir. E\u011fitimler, de\u011fi\u015fen ve ortaya \u00e7\u0131kan yeni risklere uygun olarak yenilenir, gerekti\u011finde ve d\u00fczenli aral\u0131klarla tekrarlan\u0131r.<\/p>\n<p>(2) \u00c7al\u0131\u015fan temsilcileri \u00f6zel olarak e\u011fitilir.<\/p>\n<p>(3) Mesleki e\u011fitim alma zorunlulu\u011fu bulunan tehlikeli ve \u00e7ok tehlikeli s\u0131n\u0131fta yer alan i\u015flerde, yapaca\u011f\u0131 i\u015fle ilgili mesleki e\u011fitim ald\u0131\u011f\u0131n\u0131 belgeleyemeyenler \u00e7al\u0131\u015ft\u0131r\u0131lamaz.<\/p>\n<p>(4) \u0130\u015f kazas\u0131 ge\u00e7iren veya meslek hastal\u0131\u011f\u0131na yakalanan \u00e7al\u0131\u015fana i\u015fe ba\u015flamadan \u00f6nce, s\u00f6z konusu kazan\u0131n veya meslek hastal\u0131\u011f\u0131n\u0131n sebepleri, korunma yollar\u0131 ve g\u00fcvenli \u00e7al\u0131\u015fma y\u00f6ntemleri ile ilgili ilave e\u011fitim verilir. Ayr\u0131ca, herhangi bir sebeple alt\u0131 aydan fazla s\u00fcreyle i\u015ften uzak kalanlara, tekrar i\u015fe ba\u015flat\u0131lmadan \u00f6nce bilgi yenileme e\u011fitimi verilir.<\/p>\n<p>(5) Tehlikeli ve \u00e7ok tehlikeli s\u0131n\u0131fta yer alan i\u015fyerlerinde; yap\u0131lacak i\u015flerde kar\u015f\u0131la\u015f\u0131lacak sa\u011fl\u0131k ve g\u00fcvenlik riskleri ile ilgili yeterli bilgi ve talimatlar\u0131 i\u00e7eren e\u011fitimin al\u0131nd\u0131\u011f\u0131na dair belge olmaks\u0131z\u0131n, ba\u015fka i\u015fyerlerinden \u00e7al\u0131\u015fmak \u00fczere gelen \u00e7al\u0131\u015fanlar i\u015fe ba\u015flat\u0131lamaz.<\/p>\n<p>(6) Ge\u00e7ici i\u015f ili\u015fkisi kurulan i\u015fveren, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi risklerine kar\u015f\u0131 \u00e7al\u0131\u015fana gerekli e\u011fitimin verilmesini sa\u011flar.<\/p>\n<p>(7) Bu madde kapsam\u0131nda verilecek e\u011fitimin maliyeti \u00e7al\u0131\u015fanlara yans\u0131t\u0131lamaz. \u00e7al\u0131\u015fma olarak de\u011ferlendirilir.<\/p>\n<p><strong>\u00c7<\/strong><strong>al<\/strong><strong>\u0131\u015f<\/strong><strong>anlar<\/strong><strong>\u0131<\/strong><strong>n g<\/strong><strong>\u00f6<\/strong><strong>r<\/strong><strong>\u00fc\u015f<\/strong><strong>lerinin al<\/strong><strong>\u0131<\/strong><strong>nmas<\/strong><strong>\u0131<\/strong><strong> ve sa<\/strong><strong>\u011f<\/strong><strong>lanmas<\/strong><strong>\u0131<\/strong><\/p>\n<p><strong>MADDE 18 <\/strong><strong>\u2013<\/strong> (1) \u0130\u015fveren, g\u00f6r\u00fc\u015f alma ve kat\u0131l\u0131m\u0131n sa\u011flanmas\u0131 konusunda, \u00e7al\u0131\u015fanlara veya iki ve daha fazla \u00e7al\u0131\u015fan temsilcisinin bulundu\u011fu i\u015fyerlerinde varsa i\u015fyeri yetkili sendika temsilcilerine yoksa \u00e7al\u0131\u015fan temsilcilerine a\u015fa\u011f\u0131daki imk\u00e2nlar\u0131 sa\u011flar:<\/p>\n<p>a) \u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi ile ilgili konularda g\u00f6r\u00fc\u015flerinin al\u0131nmas\u0131, teklif getirme hakk\u0131n\u0131n tan\u0131nmas\u0131 ve bu konulardaki g\u00f6r\u00fc\u015fmelerde yer alma ve kat\u0131l\u0131mlar\u0131n\u0131n sa\u011flanmas\u0131.<\/p>\n<p>b) Yeni teknolojilerin uygulanmas\u0131, se\u00e7ilecek i\u015f ekipman\u0131, \u00e7al\u0131\u015fma ortam\u0131 ve \u015fartlar\u0131n\u0131n \u00e7al\u0131\u015fanlar\u0131n sa\u011fl\u0131k ve g\u00fcvenli\u011fine etkisi konular\u0131nda g\u00f6r\u00fc\u015flerinin al\u0131nmas\u0131.<\/p>\n<p>(2) \u0130\u015fveren, destek elemanlar\u0131 ile \u00e7al\u0131\u015fan temsilcilerinin a\u015fa\u011f\u0131daki konularda \u00f6nceden g\u00f6r\u00fc\u015flerinin al\u0131nmas\u0131n\u0131 sa\u011flar:<\/p>\n<p>a) \u0130\u015fyerinden g\u00f6revlendirilecek veya i\u015fyeri d\u0131\u015f\u0131ndan hizmet al\u0131nacak i\u015fyeri hekimi, i\u015f g\u00fcvenli\u011fi uzman\u0131 ve di\u011fer personel ile ilk yard\u0131m, yang\u0131nla m\u00fccadele ve tahliye i\u015fleri i\u00e7in ki\u015filerin g\u00f6revlendirilmesi.<\/p>\n<p>b) Risk de\u011ferlendirmesi yap\u0131larak, al\u0131nmas\u0131 gereken koruyucu ve \u00f6nleyici tedbirlerin ve kullan\u0131lmas\u0131 gereken koruyucu donan\u0131m ve ekipman\u0131n belirlenmesi.<\/p>\n<p>c) Sa\u011fl\u0131k ve g\u00fcvenlik risklerinin \u00f6nlenmesi ve koruyucu hizmetlerin y\u00fcr\u00fct\u00fclmesi.<\/p>\n<p>\u00e7) \u00c7al\u0131\u015fanlar\u0131n bilgilendirilmesi.<\/p>\n<p>d) \u00c7al\u0131\u015fanlara verilecek e\u011fitimin planlanmas\u0131.<\/p>\n<p>(3) \u00c7al\u0131\u015fanlar\u0131n veya \u00e7al\u0131\u015fan temsilcilerinin, i\u015fyerinde i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi i\u00e7in al\u0131nan \u00f6nlemlerin yetersiz oldu\u011fu durumlarda veya tefti\u015f s\u0131ras\u0131nda, yetkili makama ba\u015fvurmalar\u0131ndan dolay\u0131 haklar\u0131 k\u0131s\u0131tlanamaz.<\/p>\n<p><strong>\u00c7<\/strong><strong>al<\/strong><strong>\u0131\u015f<\/strong><strong>anlar<\/strong><strong>\u0131<\/strong><strong>n y<\/strong><strong>\u00fc<\/strong><strong>k<\/strong><strong>\u00fc<\/strong><strong>ml<\/strong><strong>\u00fc<\/strong><strong>l<\/strong><strong>\u00fc<\/strong><strong>kleri<\/strong><\/p>\n<p><strong>MADDE 19 <\/strong><strong>\u2013<\/strong> (1) \u00c7al\u0131\u015fanlar, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi ile ilgili ald\u0131klar\u0131 e\u011fitim ve i\u015fverenin bu konudaki talimatlar\u0131 do\u011frultusunda, kendilerinin ve hareketlerinden veya yapt\u0131klar\u0131 i\u015ften etkilenen di\u011fer \u00e7al\u0131\u015fanlar\u0131n sa\u011fl\u0131k ve g\u00fcvenliklerini tehlikeye d\u00fc\u015f\u00fcrmemekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n<p>(2) \u00c7al\u0131\u015fanlar\u0131n, i\u015fveren taraf\u0131ndan verilen e\u011fitim ve talimatlar do\u011frultusunda y\u00fck\u00fcml\u00fcl\u00fckleri \u015funlard\u0131r:<\/p>\n<p>a) \u0130\u015fyerindeki makine, cihaz, ara\u00e7, gere\u00e7, tehlikeli madde, ta\u015f\u0131ma ekipman\u0131 ve di\u011fer \u00fcretim ara\u00e7lar\u0131n\u0131 kurallara uygun \u015fekilde kullanmak, bunlar\u0131n g\u00fcvenlik donan\u0131mlar\u0131n\u0131 do\u011fru olarak kullanmak, keyfi olarak \u00e7\u0131karmamak ve de\u011fi\u015ftirmemek.<\/p>\n<p>b) Kendilerine sa\u011flanan ki\u015fisel koruyucu donan\u0131m\u0131 do\u011fru kullanmak ve korumak.<\/p>\n<p>c) \u0130\u015fyerindeki makine, cihaz, ara\u00e7, gere\u00e7, tesis ve binalarda sa\u011fl\u0131k ve g\u00fcvenlik y\u00f6n\u00fcnden ciddi ve yak\u0131n bir tehlike ile kar\u015f\u0131la\u015ft\u0131klar\u0131nda ve koruma tedbirlerinde bir eksiklik g\u00f6rd\u00fcklerinde, i\u015fverene veya \u00e7al\u0131\u015fan temsilcisine derhal haber vermek.<\/p>\n<p>\u00e7) Tefti\u015fe yetkili makam taraf\u0131ndan i\u015fyerinde tespit edilen noksanl\u0131k ve mevzuata ayk\u0131r\u0131l\u0131klar\u0131n giderilmesi konusunda, i\u015fveren ve \u00e7al\u0131\u015fan temsilcisi ile i\u015f birli\u011fi yapmak.<\/p>\n<p>d) Kendi g\u00f6rev alan\u0131nda, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011finin sa\u011flanmas\u0131 i\u00e7in i\u015fveren ve \u00e7al\u0131\u015fan temsilcisi ile i\u015f birli\u011fi yapmak.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>\u00c7<\/strong><strong>al<\/strong><strong>\u0131\u015f<\/strong><strong>an temsilcisi<\/strong><\/p>\n<p><strong>MADDE 20 <\/strong><strong>\u2013<\/strong> (1) \u0130\u015fveren; i\u015fyerinin de\u011fi\u015fik b\u00f6l\u00fcmlerindeki riskler ve \u00e7al\u0131\u015fan say\u0131lar\u0131n\u0131 g\u00f6z \u00f6n\u00fcnde bulundurarak dengeli da\u011f\u0131l\u0131ma \u00f6zen g\u00f6stermek kayd\u0131yla, \u00e7al\u0131\u015fanlar aras\u0131nda yap\u0131lacak se\u00e7im veya se\u00e7imle belirlenemedi\u011fi durumda atama yoluyla, a\u015fa\u011f\u0131da belirtilen say\u0131larda \u00e7al\u0131\u015fan temsilcisini g\u00f6revlendirir:<\/p>\n<p>a) \u0130ki ile elli aras\u0131nda \u00e7al\u0131\u015fan\u0131 bulunan i\u015fyerlerinde bir.<\/p>\n<p>b) Ellibir ile y\u00fcz aras\u0131nda \u00e7al\u0131\u015fan\u0131 bulunan i\u015fyerlerinde iki.<\/p>\n<p>c) Y\u00fczbir ile temsilcileri aras\u0131nda yap\u0131lacak se\u00e7imle belirlenir.<\/p>\n<p>(3) \u00c7al\u0131\u015fan temsilcileri, tehlike kayna\u011f\u0131n\u0131n yok edilmesi veya tehlikeden kaynaklanan riskin azalt\u0131lmas\u0131 i\u00e7in, i\u015fverene \u00f6neride bulunma ve i\u015fverenden gerekli tedbirlerin al\u0131nmas\u0131n\u0131 isteme hakk\u0131na sahiptir.<\/p>\n<p>(4) G\u00f6revlerini y\u00fcr\u00fctmeleri nedeniyle, \u00e7al\u0131\u015fan temsilcileri ve destek elemanlar\u0131n\u0131n haklar\u0131 k\u0131s\u0131tlanamaz ve g\u00f6revlerini yerine getirebilmeleri i\u00e7in i\u015fveren taraf\u0131ndan gerekli imk\u00e2nlar sa\u011flan\u0131r.<\/p>\n<p>(5) \u0130\u015fyerinde yetkili sendika bulunmas\u0131 h\u00e2linde, i\u015fyeri sendika temsilcileri \u00e7al\u0131\u015fan temsilcisi olarak da g\u00f6rev yapar.<\/p>\n<p><strong>\u00dc\u00c7\u00dc<\/strong><strong>NC<\/strong><strong>\u00dc<\/strong><strong> <\/strong><strong>\u0130\u015f<\/strong><strong> Sa<\/strong><strong>\u011f<\/strong><strong>l<\/strong><strong>\u0131\u011f\u0131<\/strong><strong> ve G<\/strong><strong>\u00fc<\/strong><strong>venli<\/strong><strong>\u011f<\/strong><strong>i Konseyi<\/strong><\/p>\n<p><strong>MADDE 21 <\/strong><strong>\u2013<\/strong> (1) \u00dclke genelinde i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi ile ilgili politika ve stratejilerin belirlenmesi i\u00e7in tavsiyelerde bulunmak \u00fczere Konsey kurulmu\u015ftur.<\/p>\n<p>(2) Konsey, Bakanl\u0131k M\u00fcste\u015far\u0131n\u0131n ba\u015fkanl\u0131\u011f\u0131nda a\u015fa\u011f\u0131da belirtilen \u00fcyelerden olu\u015fur:<\/p>\n<p>a) Bakanl\u0131k \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Genel M\u00fcd\u00fcr\u00fc, \u00c7al\u0131\u015fma Genel M\u00fcd\u00fcr\u00fc, \u0130\u015f Tefti\u015f Kurulu Ba\u015fkan\u0131 ve Sosyal Ziraat Odalar\u0131 Birli\u011finden konuyla ilgili veya g\u00f6revli birer y\u00f6netim kurulu \u00fcyesi.<\/p>\n<p>d) \u0130htiya\u00e7 duyulmas\u0131 h\u00e2linde \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Genel M\u00fcd\u00fcr\u00fcn\u00fcn teklifi ve Konseyin karar\u0131 ile belirlenen, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi konusunda faaliyet g\u00f6steren kurum veya kurulu\u015flardan en fazla iki temsilci.<\/p>\n<p>(3) \u0130kinci f\u0131kran\u0131n (d) bendi kapsam\u0131nda belirlenen Konsey \u00fcyeleri, iki y\u0131l i\u00e7in se\u00e7ilir ve \u00fcst \u00fcste iki ola\u011fan toplant\u0131ya kat\u0131lmaz ise ilgili kurum veya kurulu\u015fun \u00fcyeli\u011fi sona erer.<\/p>\n<p>(4) Konseyin sekretaryas\u0131, \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcnce y\u00fcr\u00fct\u00fcl\u00fcr.<\/p>\n<p>(5) Konsey, toplant\u0131ya kat\u0131lanlar\u0131n salt \u00e7o\u011funlu\u011fu ile karar verir. Oylar\u0131n e\u015fitli\u011fi h\u00e2linde ba\u015fkan\u0131n oyu karar\u0131 belirler. \u00c7ekimser oy kullan\u0131lamaz.<\/p>\n<p>(6) Konsey y\u0131lda iki defa ola\u011fan toplan\u0131r. Ba\u015fkan\u0131n veya \u00fcyelerin \u00fc\u00e7te birinin teklifi ile ola\u011fan\u00fcst\u00fc olarak da toplanabilir.<\/p>\n<p>(7) Konseyin \u00e7al\u0131\u015fma usul ve esaslar\u0131 Bakanl\u0131k taraf\u0131ndan belirlenir.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>\u0130\u015f<\/strong><strong> sa<\/strong><strong>\u011f<\/strong><strong>l<\/strong><strong>\u0131\u011f\u0131<\/strong><strong> ve g<\/strong><strong>\u00fc<\/strong><strong>venli<\/strong><strong>\u011f<\/strong><strong>i kurulu<\/strong><\/p>\n<p><strong>MADDE 22 <\/strong><strong>\u2013<\/strong> (1) Elli ve daha fazla \u00e7al\u0131\u015fan\u0131n bulundu\u011fu ve alt\u0131 aydan fazla s\u00fcren s\u00fcrekli i\u015flerin yap\u0131ld\u0131\u011f\u0131 i\u015fyerlerinde i\u015fveren, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi ile ilgili \u00e7al\u0131\u015fmalarda bulunmak \u00fczere kurul olu\u015fturur. \u0130\u015fveren, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi mevzuat\u0131na uygun kurul kararlar\u0131n\u0131 uygular.<\/p>\n<p>(2) Alt\u0131 aydan fazla s\u00fcren as\u0131l i\u015fveren-alt i\u015fveren ili\u015fkisinin bulundu\u011fu hallerde;<\/p>\n<p>a) As\u0131l i\u015fveren ve alt i\u015fveren taraf\u0131ndan ayr\u0131 ayr\u0131 kurul olu\u015fturulmu\u015f ise, faaliyetlerin y\u00fcr\u00fct\u00fclmesi ve kararlar\u0131n uygulanmas\u0131 konusunda i\u015f birli\u011fi ve koordinasyon as\u0131l i\u015fverence sa\u011flan\u0131r.<\/p>\n<p>b) As\u0131l i\u015fveren taraf\u0131ndan kurul olu\u015fturulmu\u015f ise, kurul olu\u015fturmas\u0131 gerekmeyen alt i\u015fveren, koordinasyonu sa\u011flamak \u00fczere vek\u00e2leten yetkili bir temsilci atar.<\/p>\n<p>c) \u0130\u015fyerinde kurul olu\u015fturmas\u0131 gerekmeyen as\u0131l i\u015fveren, alt i\u015fverenin olu\u015fturdu\u011fu kurula i\u015f birli\u011fi ve koordinasyonu sa\u011flamak \u00fczere vek\u00e2leten yetkili bir temsilci atar.<\/p>\n<p>\u00e7) Kurul olu\u015fturmas\u0131 gerekmeyen as\u0131l i\u015fveren ve alt i\u015fverenin toplam \u00e7al\u0131\u015fan say\u0131s\u0131 elliden fazla ise, koordinasyonu as\u0131l i\u015fverence yap\u0131lmak kayd\u0131yla, as\u0131l i\u015fveren ve alt i\u015fveren taraf\u0131ndan birlikte bir kurul olu\u015fturulur.<\/p>\n<p>(3) Ayn\u0131 \u00e7al\u0131\u015fma alan\u0131nda birden fazla i\u015fverenin bulunmas\u0131 ve bu i\u015fverenlerce birden fazla kurulun olu\u015fturulmas\u0131 h\u00e2linde i\u015fverenler, birbirlerinin \u00e7al\u0131\u015fmalar\u0131n\u0131 etkileyebilecek kurul kararlar\u0131 hakk\u0131nda di\u011fer i\u015fverenleri bilgilendirir.<\/p>\n<p><strong>\u0130\u015f<\/strong><strong> sa<\/strong><strong>\u011f<\/strong><strong>l<\/strong><strong>\u0131\u011f\u0131<\/strong><strong> ve g<\/strong><strong>\u00fc<\/strong><strong>venli<\/strong><strong>\u011f<\/strong><strong>inin koordinasyonu<\/strong><\/p>\n<p><strong>MADDE 23 <\/strong><strong>\u2013<\/strong> (1) Ayn\u0131 \u00e7al\u0131\u015fma alan\u0131n\u0131 birden fazla i\u015fverenin payla\u015fmas\u0131 durumunda i\u015fverenler; i\u015f hijyeni ile i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi \u00f6nlemlerinin uygulanmas\u0131nda i\u015f birli\u011fi yapar, yap\u0131lan i\u015fin yap\u0131s\u0131 g\u00f6z \u00f6n\u00fcne al\u0131narak mesleki risklerin \u00f6nlenmesi ve bu risklerden korunulmas\u0131 \u00e7al\u0131\u015fmalar\u0131n\u0131 koordinasyon i\u00e7inde yapar, birbirlerini ve \u00e7al\u0131\u015fan temsilcilerini bu riskler konusunda bilgilendirir.<\/p>\n<p>(2) Birden fazla i\u015fyerinin bulundu\u011fu i\u015f merkezleri, i\u015f hanlar\u0131, sanayi b\u00f6lgeleri veya siteleri gibi yerlerde, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi konusundaki koordinasyon y\u00f6netim taraf\u0131ndan sa\u011flan\u0131r. Y\u00f6netim, i\u015fyerlerinde i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi y\u00f6n\u00fcnden di\u011fer i\u015fyerlerini etkileyecek tehlikeler hususunda gerekli tedbirleri almalar\u0131 i\u00e7in i\u015fverenleri uyar\u0131r. Bu uyar\u0131lara uymayan i\u015fverenleri Bakanl\u0131\u011fa bildirir.<\/p>\n<p><strong>D<\/strong><strong>\u00d6<\/strong><strong>RD<\/strong><strong>\u00dc<\/strong><strong>NC<\/strong><strong>\u00dc<\/strong><strong> B<\/strong><strong>\u00d6<\/strong><strong>L<\/strong><strong>\u00dc<\/strong><strong>M<\/strong><\/p>\n<p><strong>Tefti<\/strong><strong>\u015f<\/strong><strong> ve <\/strong><strong>\u0130<\/strong><strong>dari Yapt<\/strong><strong>\u0131<\/strong><strong>r<\/strong><strong>\u0131<\/strong><strong>mlar<\/strong><\/p>\n<p><strong>Tefti<\/strong><strong>\u015f<\/strong><strong>, inceleme, ara<\/strong><strong>\u015f<\/strong><strong>t<\/strong><strong>\u0131<\/strong><strong>rma, m<\/strong><strong>\u00fc<\/strong><strong>fetti<\/strong><strong>\u015f<\/strong><strong>in yetki, y<\/strong><strong>\u00fc<\/strong><strong>k<\/strong><strong>\u00fc<\/strong><strong>ml<\/strong><strong>\u00fc<\/strong><strong>l<\/strong><strong>\u00fc<\/strong><strong>k ve sorumlulu<\/strong><strong>\u011f<\/strong><strong>u<\/strong><\/p>\n<p><strong>MADDE 24 <\/strong><strong>\u2013<\/strong> (1) Bu Kanun h\u00fck\u00fcmlerinin uygulanmas\u0131n\u0131n izlenmesi ve tefti\u015fi, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi y\u00f6n\u00fcnden tefti\u015f yapmaya yetkili Bakanl\u0131k i\u015f m\u00fcfetti\u015flerince yap\u0131l\u0131r. Bu Kanun kapsam\u0131nda yap\u0131lacak tefti\u015f ve incelemelerde, 4857 say\u0131l\u0131 Kanunun 92, 93, 96, 97 ve 107 nci maddeleri uygulan\u0131r.<\/p>\n<p>(2) Bakanl\u0131k, i\u015fyerlerinde i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi konular\u0131nda \u00f6l\u00e7\u00fcm, inceleme ve ara\u015ft\u0131rma yapmaya, bu ama\u00e7la numune almaya ve e\u011fitim kurumlar\u0131 ile ortak sa\u011fl\u0131k ve g\u00fcvenlik birimlerinde kontrol ve denetim yapmaya yetkilidir. Bu konularda yetkilendirilenler m\u00fcmk\u00fcn oldu\u011fu kadar i\u015fi aksatmamak, i\u015fverenin ve i\u015fyerinin meslek s\u0131rlar\u0131 ile g\u00f6rd\u00fckleri ve \u00f6\u011frendikleri hususlar\u0131 tamamen gizli tutmakla y\u00fck\u00fcml\u00fcd\u00fcr. Kontrol ve denetimin usul ve esaslar\u0131 Bakanl\u0131k\u00e7a d\u00fczenlenir.<\/p>\n<p>(3) Askeri i\u015fyerleriyle yurt g\u00fcvenli\u011fi i\u00e7in gerekli maddeler \u00fcretilen i\u015fyerlerinin denetim ve tefti\u015fi konusu ve sonu\u00e7lar\u0131na ait i\u015flemler, Mill\u00ee Savunma Bakanl\u0131\u011f\u0131 ve Bakanl\u0131k\u00e7a birlikte haz\u0131rlanacak y\u00f6netmeli\u011fe g\u00f6re y\u00fcr\u00fct\u00fcl\u00fcr.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>\u0130\u015f<\/strong><strong>in durdurulmas<\/strong><strong>\u0131<\/strong><\/p>\n<p><strong>MADDE 25 <\/strong><strong>\u2013<\/strong> (1) \u0130\u015fyerindeki bina ve eklentilerde, \u00e7al\u0131\u015fma y\u00f6ntem ve \u015fekillerinde veya i\u015f ekipmanlar\u0131nda \u00e7al\u0131\u015fanlar i\u00e7in hayati tehlike olu\u015fturan bir husus tespit edildi\u011finde; bu tehlike giderilinceye kadar, hayati tehlikenin niteli\u011fi ve bu tehlikeden do\u011fabilecek riskin etkileyebilece\u011fi alan ile \u00e7al\u0131\u015fanlar dikkate al\u0131narak, i\u015fyerinin bir b\u00f6l\u00fcm\u00fcnde veya tamam\u0131nda i\u015f durdurulur. Ayr\u0131ca \u00e7ok tehlikeli s\u0131n\u0131fta yer alan maden, metal ve yap\u0131 i\u015fleri ile tehlikeli kimyasallarla \u00e7al\u0131\u015f\u0131lan i\u015flerin yap\u0131ld\u0131\u011f\u0131 veya b\u00fcy\u00fck end\u00fcstriyel kazalar\u0131n olabilece\u011fi i\u015fyerlerinde, risk de\u011ferlendirmesi yap\u0131lmam\u0131\u015f olmas\u0131 durumunda i\u015f durdurulur.<\/p>\n<p>(2) \u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi bak\u0131m\u0131ndan tefti\u015fe yetkili \u00fc\u00e7 i\u015f m\u00fcfetti\u015finden olu\u015fan heyet, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi bak\u0131m\u0131ndan tefti\u015fe yetkili i\u015f m\u00fcfetti\u015finin tespiti \u00fczerine gerekli incelemeleri yaparak, tespit tarihinden itibaren iki g\u00fcn i\u00e7erisinde i\u015fin durdurulmas\u0131na karar verebilir. Ancak tespit edilen hususun acil m\u00fcdahaleyi gerektirmesi h\u00e2linde; tespiti yapan i\u015f m\u00fcfetti\u015fi, heyet taraf\u0131ndan karar al\u0131n\u0131ncaya kadar ge\u00e7erli olmak kayd\u0131yla i\u015fi durdurur.<\/p>\n<p>(3) \u0130\u015fin durdurulmas\u0131 karar\u0131, ilgili m\u00fclki idare amirine ve i\u015fyeri dosyas\u0131n\u0131n bulundu\u011fu \u00c7al\u0131\u015fma ve \u0130\u015f Kurumu il m\u00fcd\u00fcrl\u00fc\u011f\u00fcne bir g\u00fcn i\u00e7inde g\u00f6nderilir. \u0130\u015fin durdurulmas\u0131 karar\u0131, m\u00fclki idare amiri taraf\u0131ndan yirmid\u00f6rt saat i\u00e7inde yerine getirilir. Ancak, tespit edilen hususun acil m\u00fcdahaleyi gerektirmesi nedeniyle verilen i\u015fin durdurulmas\u0131 karar\u0131, m\u00fclki idare amiri taraf\u0131ndan ayn\u0131 g\u00fcn yerine getirilir.<\/p>\n<p>(4) \u0130\u015fveren, yerine getirildi\u011fi tarihten itibaren alt\u0131 i\u015f g\u00fcn\u00fc i\u00e7inde, yetkili i\u015f mahkemesinde i\u015fin durdurulmas\u0131 karar\u0131na itiraz edebilir. \u0130tiraz, i\u015fin durdurulmas\u0131 karar\u0131n\u0131n uygulanmas\u0131n\u0131 etkilemez. Mahkeme itiraz\u0131 \u00f6ncelikle g\u00f6r\u00fc\u015f\u00fcr ve alt\u0131 i\u015f g\u00fcn\u00fc i\u00e7inde karara ba\u011flar. Mahkeme karar\u0131 kesindir.<\/p>\n<p>(5) \u0130\u015fverenin i\u015fin durdurulmas\u0131n\u0131 gerektiren hususlar\u0131n giderildi\u011fini Bakanl\u0131\u011fa yaz\u0131l\u0131 olarak bildirmesi h\u00e2linde, en ge\u00e7 yedi g\u00fcn i\u00e7inde i\u015fyerinde inceleme yap\u0131larak i\u015fverenin talebi sonu\u00e7land\u0131r\u0131l\u0131r.<\/p>\n<p>(6) \u0130\u015fveren, i\u015fin durdurulmas\u0131 sebebiyle i\u015fsiz kalan \u00e7al\u0131\u015fanlara \u00fccretlerini \u00f6demekle veya \u00fccretlerinde bir d\u00fc\u015f\u00fckl\u00fck olmamak \u00fczere meslek veya durumlar\u0131na g\u00f6re ba\u015fka bir i\u015f vermekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>\u0130<\/strong><strong>dari para cezalar<\/strong><strong>\u0131<\/strong><strong> ve uygulanmas<\/strong><strong>\u0131<\/strong><\/p>\n<p><strong>MADDE 26 <\/strong><strong>\u2013<\/strong> (1) Bu Kanunun;<\/p>\n<p>a) 4 \u00fcnc\u00fc maddesinin birinci f\u0131kras\u0131n\u0131n (a) ve (b) bentlerinde belirtilen y\u00fck\u00fcml\u00fcl\u00fckleri yerine getirmeyen i\u015fverene her bir y\u00fck\u00fcml\u00fcl\u00fck i\u00e7in ayr\u0131 ayr\u0131 ikibin T\u00fcrk Liras\u0131,<\/p>\n<p>b) 6 nc\u0131 maddesinin birinci f\u0131kras\u0131 gere\u011fince belirlenen nitelikte i\u015f g\u00fcvenli\u011fi uzman\u0131 veya i\u015fyeri hekimi g\u00f6revlendirmeyen i\u015fverene g\u00f6revlendirmedi\u011fi her bir ki\u015fi i\u00e7in be\u015fbin T\u00fcrk Liras\u0131, ayk\u0131r\u0131l\u0131\u011f\u0131n devam etti\u011fi ayk\u0131r\u0131 hareket eden i\u015fverene, uyulmayan her bir y\u00fck\u00fcml\u00fcl\u00fck i\u00e7in bin T\u00fcrk Liras\u0131, ayk\u0131r\u0131l\u0131\u011f\u0131n devam etti\u011fi her ay i\u00e7in ayn\u0131 miktar,<\/p>\n<p>e) 14 \u00fcnc\u00fc maddesinin birinci f\u0131kras\u0131nda belirtilen y\u00fck\u00fcml\u00fcl\u00fckleri yerine getirmeyen i\u015fverene her bir y\u00fck\u00fcml\u00fcl\u00fck i\u00e7in ayr\u0131 ayr\u0131 binbe\u015fy\u00fcz T\u00fcrk Liras\u0131, ikinci f\u0131kras\u0131nda belirtilen y\u00fck\u00fcml\u00fcl\u00fckleri yerine getirmeyen i\u015fverene ikibin T\u00fcrk Liras\u0131, d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131nda belirtilen y\u00fck\u00fcml\u00fcl\u00fckleri yerine getirmeyen sa\u011fl\u0131k hizmeti sunucular\u0131 veya yetkilendirilen sa\u011fl\u0131k hizmeti sunucular\u0131na ikibin T\u00fcrk Liras\u0131,<\/p>\n<p>f) 15 inci maddesinin birinci ve ikinci f\u0131kralar\u0131nda belirtilen y\u00fck\u00fcml\u00fcl\u00fckleri yerine getirmeyen i\u015fverene, sa\u011fl\u0131k g\u00f6zetimine tabi tutulmayan veya sa\u011fl\u0131k raporu al\u0131nmayan her \u00e7al\u0131\u015fan i\u00e7in maddesinde belirtilen y\u00fck\u00fcml\u00fcl\u00fcklere g\u00f6re i\u015fyerinin bir b\u00f6l\u00fcm\u00fcnde veya tamam\u0131nda verilen durdurma karar\u0131na uymayarak durdurulan i\u015fi y\u00f6netmelikte belirtilen \u015fartlar\u0131 yerine getirmeden devam ettiren i\u015fverene fiil ba\u015fka bir su\u00e7 olu\u015ftursa dahi onbin T\u00fcrk Liras\u0131, alt\u0131nc\u0131 f\u0131kras\u0131nda belirtilen y\u00fck\u00fcml\u00fcl\u00fckleri yerine getirmeyen i\u015fverene ihlale u\u011frayan her bir \u00e7al\u0131\u015fan i\u00e7in bin T\u00fcrk Liras\u0131, ayk\u0131r\u0131l\u0131\u011f\u0131n devam etti\u011fi her ay i\u00e7in ayn\u0131 miktar,<\/p>\n<p>m) 29 uncu maddesinde belirtilen; b\u00fcy\u00fck kaza \u00f6nleme politika belgesi haz\u0131rlamayan i\u015fverene ellibin T\u00fcrk Liras\u0131, g\u00fcvenlik raporunu haz\u0131rlay\u0131p Bakanl\u0131\u011f\u0131n de\u011ferlendirmesine sunmadan i\u015fyerini faaliyete ge\u00e7iren, i\u015fletilmesine Bakanl\u0131k\u00e7a izin verilmeyen i\u015fyerini a\u00e7an veya durdurulan i\u015fyerinde faaliyete devam eden i\u015fverene seksenbin T\u00fcrk Liras\u0131,<\/p>\n<p>n) 30 uncu maddesinde \u00f6ng\u00f6r\u00fclen y\u00f6netmeliklerde belirtilen y\u00fck\u00fcml\u00fcl\u00fckleri yerine getirmeyen i\u015fverene, uyulmayan her h\u00fck\u00fcm i\u00e7in tespit edildi\u011fi tarihten itibaren ayl\u0131k olarak bin T\u00fcrk Liras\u0131,<\/p>\n<p>idari para cezas\u0131 verilir.<\/p>\n<p>(2) Bu Kanunda belirtilen idari para cezalar\u0131 gerek\u00e7esi belirtilmek suretiyle \u00c7al\u0131\u015fma ve \u0130\u015f Kurumu il m\u00fcd\u00fcr\u00fcnce verilir. Verilen idari para cezalar\u0131 tebli\u011finden itibaren otuz g\u00fcn i\u00e7inde \u00f6denir. \u0130dari para cezalar\u0131 t\u00fczel ki\u015fili\u011fi bulunmayan kamu kurum ve kurulu\u015flar\u0131 ad\u0131na da d\u00fczenlenebilir.<\/p>\n<p><strong>H<\/strong><strong>\u00fc<\/strong><strong>k<\/strong><strong>\u00fc<\/strong><strong>m bulunmayan haller ve muafiyet<\/strong><\/p>\n<p><strong>MADDE 27 <\/strong><strong>\u2013<\/strong> (1) \u00c7al\u0131\u015fanlar\u0131n tabi olduklar\u0131 kanun h\u00fck\u00fcmleri sakl\u0131 kalmak kayd\u0131yla, bu Kanunda h\u00fck\u00fcm bulunmayan hallerde 4857 say\u0131l\u0131 Kanunun bu Kanuna ayk\u0131r\u0131 olmayan h\u00fck\u00fcmleri uygulan\u0131r.<\/p>\n<p>(2) Bu Kanuna g\u00f6re d\u00fczenlenen ka\u011f\u0131tlar damga vergisinden, i\u015flemler har\u00e7tan m\u00fcstesnad\u0131r.<\/p>\n<p>(3) Bakanl\u0131k, bu Kanuna g\u00f6re yap\u0131lacak i\u015f ve i\u015flemlere ait her t\u00fcrl\u00fc belge veya bilgiyi, elektronik ve benzeri ortamlar \u00fczerinden isteyebilir, ar\u015fivleyebilir, bu ortamlar \u00fczerinden onay, yetki, bilgi ve belge verebilir.<\/p>\n<p><strong>BE<\/strong><strong>\u015e\u0130<\/strong><strong>NC<\/strong><strong>\u0130<\/strong><strong> B<\/strong><strong>\u00d6<\/strong><strong>L<\/strong><strong>\u00dc<\/strong><strong>M<\/strong><\/p>\n<p><strong>\u00c7<\/strong><strong>e<\/strong><strong>\u015f<\/strong><strong>itli ve Ge<\/strong><strong>\u00e7<\/strong><strong>ici H<\/strong><strong>\u00fc<\/strong><strong>k<\/strong><strong>\u00fc<\/strong><strong>mler<\/strong><\/p>\n<p><strong>Ba<\/strong><strong>\u011f\u0131<\/strong><strong>ml<\/strong><strong>\u0131<\/strong><strong>l<\/strong><strong>\u0131<\/strong><strong>k yapan maddeleri kullanma yasa<\/strong><strong>\u011f\u0131<\/strong><\/p>\n<p><strong>MADDE 28 <\/strong><strong>\u2013<\/strong> (1) \u0130\u015fyerine, sarho\u015f veya uyu\u015fturucu madde alm\u0131\u015f olarak gelmek ve i\u015fyerinde alkoll\u00fc i\u00e7ki veya uyu\u015fturucu madde kullanmak yasakt\u0131r.<\/p>\n<p>(2) \u0130\u015fveren; i\u015fyeri eklentilerinden say\u0131lan k\u0131s\u0131mlarda, ne gibi hallerde, hangi zamanda ve hangi \u015fartlarla alkoll\u00fc i\u00e7ki i\u00e7ilebilece\u011fini belirleme yetkisine sahiptir.<\/p>\n<p>(3) A\u015fa\u011f\u0131daki \u00e7al\u0131\u015fanlar i\u00e7in alkoll\u00fc i\u00e7ki kullanma yasa\u011f\u0131 uygulanmaz:<\/p>\n<p>a) Alkoll\u00fc i\u00e7ki yap\u0131lan i\u015fyerlerinde \u00e7al\u0131\u015fan ve i\u015fin gere\u011fi olarak \u00fcretileni denetlemekle g\u00f6revlendirilenler.<\/p>\n<p>b) Kapal\u0131 kaplarda veya a\u00e7\u0131k olarak alkoll\u00fc i\u00e7ki sat\u0131lan veya i\u00e7ilen i\u015fyerlerinde i\u015fin gere\u011fi alkoll\u00fc i\u00e7ki i\u00e7mek zorunda olanlar.<\/p>\n<p>c) \u0130\u015finin niteli\u011fi gere\u011fi m\u00fc\u015fterilerle birlikte alkoll\u00fc i\u00e7ki i\u00e7mek zorunda olanlar.<\/p>\n<p><strong>G<\/strong><strong>\u00fc<\/strong><strong>venlik raporu veya b<\/strong><strong>\u00fc<\/strong><strong>y<\/strong><strong>\u00fc<\/strong><strong>k kaza <\/strong><strong>\u00f6<\/strong><strong>nleme politika belgesi<\/strong><\/p>\n<p><strong>MADDE 29 <\/strong><strong>\u2013<\/strong> (1) \u0130\u015fletmeye ba\u015flanmadan \u00f6nce, b\u00fcy\u00fck end\u00fcstriyel kaza olu\u015fabilecek i\u015fyerleri i\u00e7in, i\u015fyerlerinin b\u00fcy\u00fckl\u00fc\u011f\u00fcne g\u00f6re b\u00fcy\u00fck kaza \u00f6nleme politika belgesi haz\u0131rlad\u0131klar\u0131 g\u00fcvenlik raporlar\u0131n\u0131n i\u00e7erik ve yeterlilikleri Bakanl\u0131k\u00e7a incelenmesini m\u00fcteakip i\u015fyerlerini i\u015fletmeye a\u00e7abilir.<\/p>\n<p><strong>\u0130\u015f<\/strong><strong> sa<\/strong><strong>\u011f<\/strong><strong>l<\/strong><strong>\u0131\u011f\u0131<\/strong><strong> ve g<\/strong><strong>\u00fc<\/strong><strong>venli<\/strong><strong>\u011f<\/strong><strong>i ile ilgili <\/strong><strong>\u00e7<\/strong><strong>e<\/strong><strong>\u015f<\/strong><strong>itli y<\/strong><strong>\u00f6<\/strong><strong>netmelikler<\/strong><\/p>\n<p><strong>MADDE 30 <\/strong><strong>\u2013<\/strong> (1) A\u015fa\u011f\u0131daki konular ile bunlara ili\u015fkin usul ve esaslar Bakanl\u0131k\u00e7a \u00e7\u0131kar\u0131lacak y\u00f6netmeliklerle d\u00fczenlenir:<\/p>\n<p>a) \u0130lgili bakanl\u0131klar\u0131n g\u00f6r\u00fc\u015f\u00fc al\u0131narak, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011finin sa\u011flanmas\u0131, s\u00fcrd\u00fcr\u00fclmesi ve mevcut durumun iyile\u015ftirilmesi amac\u0131yla; i\u015fyeri bina ve eklentileri, i\u015f ekipman\u0131, i\u015fin her safhas\u0131nda kullan\u0131lan ve ortaya \u00e7\u0131kan maddeler, \u00e7al\u0131\u015fma ortam ve \u015fartlar\u0131, \u00f6zel risk ta\u015f\u0131yan i\u015f ekipman\u0131 ve i\u015fler ile i\u015fyerleri, \u00f6zel politika gerektiren gruplar\u0131n \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131, i\u015fin \u00f6zelli\u011fine g\u00f6re gece \u00e7al\u0131\u015fmalar\u0131 ve postalar h\u00e2linde \u00e7al\u0131\u015fmalar, sa\u011fl\u0131k kurallar\u0131 bak\u0131m\u0131ndan daha az \u00e7al\u0131\u015f\u0131lmas\u0131 gereken i\u015fler, gebe ve emziren kad\u0131nlar\u0131n \u00e7al\u0131\u015fma \u015fartlar\u0131, emzirme odalar\u0131 ve \u00e7ocuk bak\u0131m yurtlar\u0131n\u0131n kurulmas\u0131 veya d\u0131\u015far\u0131dan hizmet al\u0131nmas\u0131 ve benzeri \u00f6zel d\u00fczenleme gerektirebilecek konular ve bunlara ba\u011fl\u0131 bildirim ve izinler ile bu Kanunun uygulanmas\u0131na y\u00f6nelik di\u011fer hususlar.<\/p>\n<p>b) \u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi hizmetleri ile ilgili olarak;<\/p>\n<p>1) \u00c7al\u0131\u015fan say\u0131s\u0131 ve tehlike s\u0131n\u0131f\u0131 g\u00f6z \u00f6n\u00fcnde bulundurularak hangi i\u015fyerlerinde i\u015fyeri sa\u011fl\u0131k ve g\u00fcvenlik biriminin kurulaca\u011f\u0131, bu birimlerin fiziki \u015fartlar\u0131 ile birimlerde bulundurulacak donan\u0131m.<\/p>\n<p>2) \u0130\u015fyeri sa\u011fl\u0131k ve g\u00fcvenlik birimi ile ortak sa\u011fl\u0131k ve g\u00fcvenlik biriminde g\u00f6rev alacak i\u015fyeri hekimi, i\u015f g\u00fcvenli\u011fi uzman\u0131 ve di\u011fer sa\u011fl\u0131k personelinin nitelikleri, i\u015fe al\u0131nmalar\u0131, g\u00f6revlendirilmeleri, g\u00f6rev, yetki ve sorumluluklar\u0131, g\u00f6revlerini nas\u0131l y\u00fcr\u00fctecekleri, i\u015fyerinde \u00e7al\u0131\u015fan say\u0131s\u0131 ve i\u015fyerinin yer ald\u0131\u011f\u0131 tehlike s\u0131n\u0131f\u0131 g\u00f6z \u00f6n\u00fcnde bulundurularak asgari \u00e7al\u0131\u015fma s\u00fcreleri, i\u015fyerlerindeki tehlikeli hususlar\u0131 nas\u0131l bildirecekleri, sahip olduklar\u0131 belgelere g\u00f6re hangi i\u015fyerlerinde g\u00f6rev alabilecekleri.<\/p>\n<p>3) \u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi hizmeti sunacak ki\u015fi, kurum ve kurulu\u015flar\u0131n; g\u00f6rev, yetki ve y\u00fck\u00fcml\u00fcl\u00fckleri, belgelendirilmeleri ve yetkilendirilmeleri ile sunulacak hizmetler kapsam\u0131nda yer alan sa\u011fl\u0131k g\u00f6zetimi ve sa\u011fl\u0131k raporlar\u0131, kurulu\u015flar\u0131n fiziki \u015fartlar\u0131 ile kurulu\u015flarda bulundurulacak personel ve donan\u0131m.<\/p>\n<p>4) \u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi hizmeti sunan ki\u015fi, kurum ve kurulu\u015flardan i\u015fyeri tehlike s\u0131n\u0131f\u0131 ve \u00e7al\u0131\u015fan say\u0131s\u0131na g\u00f6re; hangi \u015fartlarda hizmet al\u0131naca\u011f\u0131, g\u00f6revlendirilecek veya istihdam edilecek ki\u015filerin say\u0131s\u0131, i\u015fyerinde verilecek hizmet s\u00fcresi ve belirlenen g\u00f6revleri hangi hallerde i\u015fverenin kendisinin \u00fcstlenebilece\u011fi.<\/p>\n<p>5) \u0130\u015fyeri hekimi, i\u015f g\u00fcvenli\u011fi uzman\u0131 ve di\u011fer sa\u011fl\u0131k personelinin e\u011fitimleri ve belgelendirilmeleri, unvanlar\u0131na g\u00f6re kimlerin hangi s\u0131n\u0131f belge alabilecekleri, i\u015fyeri hekimi, i\u015f g\u00fcvenli\u011fi uzman\u0131 ve di\u011fer sa\u011fl\u0131k personeli e\u011fitimi verecek kurumlar\u0131n belgelendirilmeleri, yetkilendirilmeleri ile e\u011fitim programlar\u0131n\u0131n ve bu programlarda g\u00f6rev alacak e\u011fiticilerin niteliklerinin belirlenmesi ve belgelendirilmeleri, e\u011fitimlerin sonunda yap\u0131lacak s\u0131navlar ve d\u00fczenlenecek belgeler.<\/p>\n<p>c) Risk de\u011ferlendirmesi ile ilgili olarak; risk de\u011ferlendirmesinin hangi i\u015fyerlerinde ne \u015fekilde yap\u0131laca\u011f\u0131, de\u011ferlendirme yapacak ki\u015fi ve kurulu\u015flar\u0131n niteliklerinin belirlenmesi, gerekli izinlerin verilmesi ve izinlerin iptal edilmesi.<\/p>\n<p>\u00e7) Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131n\u0131n g\u00f6r\u00fc\u015f\u00fc al\u0131narak, i\u015fverenlerin i\u015fyerlerinde bu Kanun kapsam\u0131nda yapmakla y\u00fck\u00fcml\u00fc olduklar\u0131 ki\u015fisel maruziyete ve \u00e7al\u0131\u015fma ortam\u0131na y\u00f6nelik gerekli kontrol, inceleme ve ara\u015ft\u0131rmalar ile fiziksel, kimyasal ve biyolojik etmenlerle ilgili \u00f6l\u00e7\u00fcm ve laboratuvar analizlerinin usul ve esaslar\u0131 ile bu \u00f6l\u00e7\u00fcm ve analizleri yapacak ki\u015fi ve kurulu\u015flar\u0131n niteliklerinin belirlenmesi, gerekli yetkilerin verilmesi ve verilen yetkilerin iptali ile yetkilendirme ve belgelendirme bedelleri.<\/p>\n<p>d) Yap\u0131lan i\u015fin niteli\u011fi, \u00e7al\u0131\u015fan say\u0131s\u0131, i\u015fyerinin b\u00fcy\u00fckl\u00fc\u011f\u00fc, kullan\u0131lan, depolanan ve \u00fcretilen maddeler, i\u015f ekipman\u0131 ve i\u015fyerinin konumu gibi hususlar dikkate al\u0131narak acil durum planlar\u0131n\u0131n haz\u0131rlanmas\u0131, \u00f6nleme, koruma, tahliye, ilk yard\u0131m ve benzeri konular ile bu konularda g\u00f6revlendirilecek ki\u015filer.<\/p>\n<p>e) \u00c7al\u0131\u015fanlara ve temsilcilerine verilecek e\u011fitimler, bu e\u011fitimlerin belgelendirilmesi, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi e\u011fitimi verecek ki\u015fi ve kurulu\u015flarda aranacak nitelikler ile mesleki e\u011fitim alma zorunlulu\u011fu bulunan i\u015fler.<\/p>\n<p>f) Kurulun olu\u015fumu, g\u00f6rev ve yetkileri, \u00e7al\u0131\u015fma usul ve esaslar\u0131, birden \u00e7ok kurul bulunmas\u0131 h\u00e2linde bu kurullar aras\u0131ndaki koordinasyon ve i\u015f birli\u011fi.<\/p>\n<p>g) \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131 ile m\u00fc\u015ftereken, i\u015fyerlerinde i\u015fin durdurulmas\u0131, hangi i\u015flerde risk de\u011ferlendirmesi yap\u0131lmam\u0131\u015f olmas\u0131 durumunda i\u015fin durdurulaca\u011f\u0131, durdurma sebeplerini gidermek i\u00e7in m\u00fch\u00fcrlerin ge\u00e7ici olarak kald\u0131r\u0131lmas\u0131, yeniden \u00e7al\u0131\u015fmaya izin verilme \u015fartlar\u0131, acil hallerde i\u015fin durdurulmas\u0131na karar verilinceye kadar ge\u00e7ecek s\u00fcrede al\u0131nacak tedbirlerin uygulanmas\u0131.<\/p>\n<p>\u011f) \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131 ile m\u00fc\u015ftereken, b\u00fcy\u00fck end\u00fcstriyel kazalar\u0131n \u00f6nlenmesi ve etkilerinin azalt\u0131lmas\u0131 i\u00e7in al\u0131nacak tedbirler, b\u00fcy\u00fck end\u00fcstriyel kaza olu\u015fabilecek i\u015fyerlerinin belirlenmesi ve s\u0131n\u0131fland\u0131r\u0131lmas\u0131, b\u00fcy\u00fck kaza \u00f6nleme politika belgesi veya g\u00fcvenlik raporunun haz\u0131rlanmas\u0131 ve uygulanmas\u0131, g\u00fcvenlik raporunun olmamas\u0131, incelenmek \u00fczere Bakanl\u0131\u011fa g\u00f6nderilmemesi veya Bakanl\u0131k\u00e7a yetersiz bulunmas\u0131 durumunda i\u015fin durdurulmas\u0131 ve i\u015fin devam\u0131na izin verilmesi.<\/p>\n<p>(2) Birinci f\u0131kran\u0131n (b) bendine g\u00f6re i\u015fyeri hekimi ve di\u011fer sa\u011fl\u0131k personeline dair \u00e7\u0131kar\u0131lan y\u00f6netmelikte yer alan i\u015fyeri hekimi ve di\u011fer sa\u011fl\u0131k personelinin e\u011fitim programlar\u0131, \u00e7al\u0131\u015fma s\u00fcreleri, g\u00f6rev ve yetkilerine ili\u015fkin hususlarda Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131n\u0131n uygun g\u00f6r\u00fc\u015f\u00fc al\u0131n\u0131r.<\/p>\n<p><strong>Belgelendirme, ihtar ve iptaller<\/strong><\/p>\n<p><strong>MADDE 31 <\/strong><strong>\u2013<\/strong> (1) \u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi hizmeti sunan, \u00f6l\u00e7\u00fcm ve analizleri yapan ki\u015fi, kurum, kurulu\u015flar ve e\u011fitim kurumlar\u0131 ile ilgili olarak yetkilendirme ve belgelendirme bedelleri, bu ki\u015fi ve kurumlara getirilen kurallar\u0131n ihlali h\u00e2linde hafif, orta ve a\u011f\u0131r ihtar olarak kayda al\u0131nmas\u0131 ile yetki belgelerinin ge\u00e7erlili\u011finin do\u011frudan veya ihtar puanlar\u0131 esas al\u0131narak ask\u0131ya al\u0131nmas\u0131 ve iptaline dair usul ve esaslar Bakanl\u0131k\u00e7a belirlenir.<\/p>\n<p><strong>De<\/strong><strong>\u011f<\/strong><strong>i<\/strong><strong>\u015f<\/strong><strong>tirilen h<\/strong><strong>\u00fc<\/strong><strong>k<\/strong><strong>\u00fc<\/strong><strong>mler<\/strong><\/p>\n<p><strong>MADDE 32 <\/strong><strong>\u2013<\/strong> 22\/5\/2003 tarihli ve 4857 say\u0131l\u0131 \u0130\u015f Kanununun;<\/p>\n<p>a) 7 nci maddesinin birinci f\u0131kras\u0131n\u0131n son c\u00fcmlesi a\u015fa\u011f\u0131daki \u015fekilde de\u011fi\u015ftirilmi\u015ftir. \u201cGe\u00e7ici i\u015f ili\u015fkisi kurulan i\u015fveren i\u015f\u00e7iye talimat verme hakk\u0131na sahiptir.\u201d<\/p>\n<p>b) 25 inci maddesinin birinci f\u0131kras\u0131n\u0131n (II) numaral\u0131 bendinin (d) alt bendinde yer alan \u201cveya 84 \u00fcnc\u00fc maddeye ayk\u0131r\u0131 hareket etmesi\u201d ibaresi \u201c, i\u015fyerine sarho\u015f yahut uyu\u015fturucu madde alm\u0131\u015f olarak gelmesi ya da i\u015fyerinde bu maddeleri kullanmas\u0131\u201d \u015feklinde de\u011fi\u015ftirilmi\u015ftir.<\/p>\n<p>c) 71 inci maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131nda ge\u00e7en \u201chafif i\u015fler\u201d ibaresinden sonra gelmek \u00fczere \u201c, onalt\u0131 ya\u015f\u0131n\u0131 doldurmu\u015f fakat onsekiz ya\u015f\u0131n\u0131 bitirmemi\u015f gen\u00e7 i\u015f\u00e7ilerin hangi \u00e7e\u015fit i\u015flerde \u00e7al\u0131\u015ft\u0131r\u0131labilecekleri\u201d ibaresi eklenmi\u015ftir.<\/p>\n<p><strong>MADDE 33 <\/strong><strong>\u2013<\/strong> 13\/12\/1983 tarihli ve 190 say\u0131l\u0131 Genel Kadro ve Usul\u00fc Hakk\u0131nda Kanun H\u00fckm\u00fcnde Kararnamenin eki (I) say\u0131l\u0131 cetvelin \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131na ait b\u00f6l\u00fcm\u00fcnde yer alan \u201cBa\u015f \u0130\u015f M\u00fcfetti\u015fi\u201d unvanl\u0131 kadrolar \u201c\u0130\u015f Ba\u015fm\u00fcfetti\u015fi\u201d olarak de\u011fi\u015ftirilmi\u015ftir.<\/p>\n<p><strong>MADDE 34 <\/strong><strong>\u2013<\/strong> Ekli (I), (II) ve (III) say\u0131l\u0131 listelerde yer alan kadrolar ihdas edilerek 190 say\u0131l\u0131 Kanun H\u00fckm\u00fcnde Kararnamenin eki (I) say\u0131l\u0131 cetvelin \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131na ait b\u00f6l\u00fcm\u00fcne eklenmi\u015f, ekli (IV) say\u0131l\u0131 listede yer alan kadrolar iptal edilerek 190 say\u0131l\u0131 Kanun H\u00fckm\u00fcnde Kararnamenin eki (I) say\u0131l\u0131 cetvelin \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131na ait b\u00f6l\u00fcm\u00fcnden \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p><strong>MADDE 35 <\/strong><strong>\u2013<\/strong> 14\/7\/1965 tarihli ve 657 say\u0131l\u0131 Devlet Memurlar\u0131 Kanununa ekli (II) say\u0131l\u0131 cetvelin \u201c4. Ba\u015fbakanl\u0131k ve Bakanl\u0131klarda\u201d b\u00f6l\u00fcm\u00fcnde yer alan \u201c\u0130\u015f\u00e7i Sa\u011fl\u0131\u011f\u0131 ve \u0130\u015f G\u00fcvenli\u011fi Ens. M\u00fcd.\u201d ibaresi \u201c\u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Enstit\u00fc M\u00fcd\u00fcr\u00fc\u201d olarak de\u011fi\u015ftirilmi\u015ftir.<\/p>\n<p><strong>MADDE 36 <\/strong><strong>\u2013<\/strong> 9\/1\/1985 tarihli ve 3146 say\u0131l\u0131 \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131n\u0131n Te\u015fkilat ve G\u00f6revleri Hakk\u0131nda Kanuna a\u015fa\u011f\u0131daki ek madde eklenmi\u015ftir.<\/p>\n<p>\u201cYay\u0131n zorunlulu\u011fu<\/p>\n<p>EK MADDE 2 \u2013 T\u00fcrkiye Radyo-Televizyon Kurumu ile ulusal, b\u00f6lgesel ve yerel yay\u0131n yapan \u00f6zel televizyon kurulu\u015flar\u0131 ve radyolar; ayda en az altm\u0131\u015f dakika i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi, \u00e7al\u0131\u015fma hayat\u0131nda kay\u0131t d\u0131\u015f\u0131l\u0131\u011f\u0131n \u00f6nlenmesi, sosyal g\u00fcvenlik, i\u015f\u00e7i ve i\u015fveren ili\u015fkileri konular\u0131nda uyar\u0131c\u0131 ve e\u011fitici mahiyette yay\u0131nlar yapmak zorundad\u0131r. Bu yay\u0131nlar, asgari otuz dakikas\u0131 17:00-22:00 saatleri aras\u0131nda olmak \u00fczere, 08:00-22:00 saatleri aras\u0131nda yap\u0131l\u0131r ve yay\u0131nlar\u0131n kopyalar\u0131 her ay d\u00fczenli olarak Radyo ve Televizyon \u00dcst Kuruluna teslim edilir. Bu saatler d\u0131\u015f\u0131nda yap\u0131lan yay\u0131nlar, ayl\u0131k altm\u0131\u015f dakikal\u0131k s\u00fcreye dahil edilmez. Bu programlar, Bakanl\u0131k ve ba\u011fl\u0131 ve ilgili kurulu\u015flar\u0131, Radyo ve Televizyon \u00dcst Kurulu ile ilgili di\u011fer kamu kurum ve kurulu\u015flar\u0131 ile bilimsel kurulu\u015flar, kamu kurumu niteli\u011finde meslek kurulu\u015flar\u0131 veya sivil toplum kurulu\u015flar\u0131 taraf\u0131ndan haz\u0131rlan\u0131r veya haz\u0131rlat\u0131l\u0131r. Haz\u0131rlanan programlar\u0131n, Bakanl\u0131\u011f\u0131n olumlu g\u00f6r\u00fc\u015f\u00fc al\u0131nd\u0131ktan sonra Radyo ve Televizyon \u00dcst Kurulu taraf\u0131ndan radyo ve televizyonlarda yay\u0131nlanmas\u0131 sa\u011flan\u0131r.<\/p>\n<p>Bu madde kapsam\u0131nda yap\u0131lan yay\u0131nlar i\u00e7in herhangi bir bedel \u00f6denmez. tehlikeli s\u0131n\u0131fta yer alan i\u015fyerlerinde ise (B) s\u0131n\u0131f\u0131 belgeye sahip i\u015f g\u00fcvenli\u011fi uzman\u0131 g\u00f6revlendirme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc, bu i\u015fyerlerinde Kanunun y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten itibaren \u00fc\u00e7 y\u0131l s\u00fcreyle (C) s\u0131n\u0131f\u0131 belgeye sahip i\u015f g\u00fcvenli\u011fi uzman\u0131 g\u00f6revlendirilmesi kayd\u0131yla yerine getirilmi\u015f say\u0131l\u0131r.<\/p>\n<p><strong>Mevcut sertifika ve belgeler ile ihtar puanlar<\/strong><strong>\u0131<\/strong><\/p>\n<p><strong>GE<\/strong><strong>\u00c7\u0130<\/strong><strong>C<\/strong><strong>\u0130<\/strong><strong> MADDE 5 <\/strong><strong>\u2013<\/strong> (1) Bu Kanunun yay\u0131m\u0131 tarihinden \u00f6nce Bakanl\u0131k\u00e7a verilen i\u015fyeri hekimli\u011fi, i\u015f g\u00fcvenli\u011fi uzmanl\u0131\u011f\u0131 ve i\u015fyeri hem\u015firesi sertifikas\u0131 veya belgesi ile T\u00fcrk Tabipleri Birli\u011fi taraf\u0131ndan verilen i\u015fyeri hekimli\u011fi sertifikas\u0131 sahiplerinden belgeleri ge\u00e7ersiz say\u0131lanlar, mevcut belge veya sertifikalar\u0131n\u0131 bu Kanunun yay\u0131m\u0131ndan itibaren bir y\u0131l i\u00e7inde Bakanl\u0131k\u00e7a d\u00fczenlenecek belge ile de\u011fi\u015ftirmeleri \u015fart\u0131yla bu Kanunla verilen b\u00fct\u00fcn hak ve yetkileri kullanabilirler. Ayn\u0131 tarihten \u00f6nce e\u011fitim kurumlar\u0131nca verilen i\u015fyeri hekimli\u011fi ve i\u015f g\u00fcvenli\u011fi uzmanl\u0131\u011f\u0131 e\u011fitimlerini tamamlayanlardan e\u011fitimleri ge\u00e7ersiz say\u0131lanlar ilgili mevzuata g\u00f6re s\u0131nava girmeye hak kazan\u0131rlar. Hak sahipli\u011finin tespitinde Bakanl\u0131k kay\u0131tlar\u0131 esas al\u0131n\u0131r.<\/p>\n<p>(2) Bu Kanunun yay\u0131m\u0131 tarihinden \u00f6nce haklar\u0131nda kesinle\u015fmi\u015f yarg\u0131 karar\u0131 bulunmayan e\u011fitim kurumu ve ortak sa\u011fl\u0131k ve g\u00fcvenlik birimlerine uygulanan ihtar puanlar\u0131, kay\u0131tlarda yer alan haliyle yeni yap\u0131lacak d\u00fczenlemeye aktar\u0131l\u0131r.<\/p>\n<p><strong>\u0130\u015f<\/strong><strong>yeri hekimli<\/strong><strong>\u011f<\/strong><strong>i yapan kurum tabiplerine yap<\/strong><strong>\u0131<\/strong><strong>lan <\/strong><strong>\u00fc<\/strong><strong>cret <\/strong><strong>\u00f6<\/strong><strong>demeleri<\/strong><\/p>\n<p><strong>GE<\/strong><strong>\u00c7\u0130<\/strong><strong>C<\/strong><strong>\u0130<\/strong><strong> MADDE 6 <\/strong><strong>\u2013<\/strong> (1) Kamu kurum ve kurulu\u015flar\u0131 ile mahalli idarelerde ger\u00e7ekle\u015ftirilmi\u015f olan i\u015fyeri hekimli\u011fi \u00fccreti \u00f6demeleri nedeniyle kamu g\u00f6revlileri hakk\u0131nda idari veya mali yarg\u0131lama ve takibat yap\u0131lamaz, ba\u015flat\u0131lanlar i\u015flemden kald\u0131r\u0131l\u0131r, bu \u00f6demeler geriye tahsil ve tazmin konusu edilemez.<\/p>\n<p><strong>GE<\/strong><strong>\u00c7\u0130<\/strong><strong>C<\/strong><strong>\u0130<\/strong><strong> MADDE 7 <\/strong><strong>\u2013<\/strong> (1) Bu Kanunun yay\u0131m\u0131 tarihinde Ba\u015f \u0130\u015f M\u00fcfetti\u015fi kadrolar\u0131nda bulunanlar, hi\u00e7bir i\u015fleme gerek kalmaks\u0131z\u0131n \u0130\u015f Ba\u015fm\u00fcfetti\u015fi kadrolar\u0131na atanm\u0131\u015f say\u0131l\u0131r.<\/p>\n<p><strong>GE<\/strong><strong>\u00c7\u0130<\/strong><strong>C<\/strong><strong>\u0130<\/strong><strong> MADDE 8 <\/strong><strong>\u2013<\/strong> (1) Bu Kanunun yay\u0131mland\u0131\u011f\u0131 tarihte \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Merkez M\u00fcd\u00fcrl\u00fc\u011f\u00fcnde \u0130\u015f\u00e7i Sa\u011fl\u0131\u011f\u0131 ve \u0130\u015f G\u00fcvenli\u011fi Enstit\u00fc M\u00fcd\u00fcr\u00fc ile \u0130\u015f\u00e7i Sa\u011fl\u0131\u011f\u0131 ve \u0130\u015f G\u00fcvenli\u011fi Enstit\u00fc M\u00fcd\u00fcr Yard\u0131mc\u0131s\u0131 unvanl\u0131 kadrolarda bulunanlar\u0131n g\u00f6revleri, bu Kanunun yay\u0131mland\u0131\u011f\u0131 tarihte sona erer ve bunlar en ge\u00e7 bir ay i\u00e7inde derece ve kademelerine uygun di\u011fer kadrolara atan\u0131r. Bunlar, yeni bir kadroya atan\u0131ncaya kadar, eski kadrolar\u0131na ait ayl\u0131k, ek g\u00f6sterge ve her t\u00fcrl\u00fc zam ve tazminatlar ile di\u011fer mali haklar\u0131n\u0131 almaya devam eder. S\u00f6z konusu personelin atand\u0131klar\u0131 tarih itibar\u0131yla eski kadrolar\u0131na ili\u015fkin olarak en son ayda ald\u0131klar\u0131 ayl\u0131k, ek g\u00f6sterge, her t\u00fcrl\u00fc zam ve tazminatlar\u0131, ek \u00f6deme ve benzeri adlarla yap\u0131lan her t\u00fcrl\u00fc \u00f6demelerin (ilgili mevzuat\u0131 uyar\u0131nca fiili \u00e7al\u0131\u015fmaya ba\u011fl\u0131 fazla mesai \u00fccreti ve ek ders \u00fccreti hari\u00e7) toplam net tutar\u0131n\u0131n (bu tutar sabit bir de\u011fer olarak esas al\u0131n\u0131r); yeni atand\u0131klar\u0131 kadrolara ili\u015fkin olarak yap\u0131lan ayl\u0131k, ek g\u00f6sterge, her t\u00fcrl\u00fc zam ve tazminatlar\u0131, ek \u00f6deme ve benzeri adlarla yap\u0131lan her t\u00fcrl\u00fc \u00f6demelerin (ilgili mevzuat\u0131 uyar\u0131nca fiili \u00e7al\u0131\u015fmaya ba\u011fl\u0131 fazla mesai \u00fccreti ve ek ders \u00fccreti hari\u00e7) toplam net tutar\u0131ndan fazla olmas\u0131 h\u00e2linde aradaki fark tutar\u0131, herhangi bir vergi ve kesintiye tabi tutulmaks\u0131z\u0131n fark kapan\u0131ncaya kadar ayr\u0131ca tazminat olarak \u00f6denir. Atand\u0131klar\u0131 kadro unvanlar\u0131nda iste\u011fe ba\u011fl\u0131 olarak herhangi bir de\u011fi\u015fiklik olanlarla kendi istekleriyle ba\u015fka kurumlara atananlara fark tazminat\u0131 \u00f6denmesine son verilir.<\/p>\n<p>(2) Bu Kanuna ekli listelerde ihdas edilen kadrolardan bo\u015f bulunan 20 \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Uzman\u0131, 100 \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Uzman Yard\u0131mc\u0131s\u0131, 40 Memur, 40 Veri Haz\u0131rlama ve Kontrol \u0130\u015fletmeni ve 10 M\u00fchendis kadrosuna, 21\/12\/2011 tarihli ve 6260 say\u0131l\u0131 2012 y\u0131l\u0131 Merkezi Y\u00f6netim B\u00fct\u00e7e Kanundaki s\u0131n\u0131rlamalara tabi olmadan 2012 y\u0131l\u0131 i\u00e7inde atama yap\u0131labilir.<\/p>\n<p><strong>Y<\/strong><strong>\u00fc<\/strong><strong>r<\/strong><strong>\u00fc<\/strong><strong>rl<\/strong><strong>\u00fc<\/strong><strong>k<\/strong><\/p>\n<p><strong>MADDE
